Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman DeCosta Hastings.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Nashville Airport Authority
Appointment of Mr. Bill Freeman for a term expiring January 1, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Nashville Arts Commission
Appointment of Mr. Manuel Delgado for a term expiring January 1, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Meg MacFadyen for a term expiring January 1, 2020. At the request of the nominee, the confirmation was deferred.

Community Corrections Advisory Board
Appointment of Mr. Eric Brown for a term expiring January 19, 2018. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Education Commission
Reappointment of Mr. Brian Gilson for a term expiring October 6, 2018. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electrical Examiners and Appeals Board
Appointment of Mr. Wayne Settles for a term expiring October 10, 2019. The Rules-Confirmations-Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Housing Trust Fund Commission
Appointment of Mr. Chris Ferrell for a term expiring September 17, 2017. Mr. Ferrell will fill the unexpired term of Mr. Steve Neighbors. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Lara Tucker for a term expiring September 17, 2016. Ms. Tucker will fill the unexpired term of Mr. Bern Schaedle. Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-87

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County and JusticeTrax to provide maintenance and support for software utilized by the Metropolitan Nashville Police Department. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-88

A resolution accepting a grant from the U.S. Food and Drug Administration, Retail Standards Grant Program, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund food inspection self-assessment to comply with Standard One of the FDA Voluntary Retail Food Program Standards. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-89

A resolution accepting a grant from the U.S. Food and Drug Administration, Retail Standards Grant Program, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund travel expenses for food inspectors to attend the FD 312 Special Processes at Retail course to prepare participants to inspect retail and food service establishments. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-90

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for the provision of immunization program activities and staffing to monitor and assess the delivery of immunization services by providers in Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-91

A resolution approving Amendment Two to a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for family planning services. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-92

A resolution accepting a grant from Linda Rising to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission to benefit the How’s Nashville Project. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-93

A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Village Learning Center, LLC I to provide weekly preschool classroom nutrition education and food preparation training sessions in conjunction with the Project Diabetes Gold Sneaker Program. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-94

A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Village Learning Center, LLC II to provide weekly preschool classroom nutrition education and food preparation training sessions in conjunction with the Project Diabetes Gold Sneaker Program. RESOLUTION NO. RS2016-95

A resolution accepting a grant from the Tennessee State Library and Archives to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to provide a well-trained library staff to assist customers in accessing technology as a means of closing the digital divide. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-96

A resolution authorizing The Connor Group, a real estate investment firm doing business as GL Elliston 23 Apt, LLC to construct and install an aerial encroachment at 2300 Elliston Place (Proposal No.2015M-032EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-97

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

- RESOLUTIONS -

RESOLUTION NO. RS2015-76

A resolution requesting the Metropolitan Board of Fair Commissioners to reinstate and continue to allow gun shows on Fairgrounds property and to otherwise comply with Section 11.602 of the Metropolitan Charter. The Codes, Fair, and Farmers Market Committee recommended deferment to the second meeting in March. Mr. Glover moved to defer the resolution to the second meeting in March, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-86

A resolution authorizing the Metropolitan Development and Housing Agency to negotiate and enter into a PILOT Agreement and accept payments in lieu of ad valorem taxes with respect to a multi-family housing project located at 5515 Scruggs Lane, also known as 230 West Trinity Lane, to be known as the Paddock at Grandview. The Budget and Finance Committee recommended deferment. Mr. Hastings moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-98

A resolution honoring the life of Richard M. Morin. The Rules, Confirmations, and Public Elections Committee recommended deferment. Ms. Weiner moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-99

A resolution recognizing February 5, 2016 as National Wear Red Day. The resolution was approved by the Rules, Confirmations, and Public Elections Committees. BILL NO. BL2016-119

An ordinance approving an agreement granting CCA of Tennessee, LLC access to the 800-MHZ system for public safety purposes. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees by a voice vote of the Council.

BILL NO. BL2016-120

An Ordinance authorizing PSREG Church Street Owner, LLC to install, construct and maintain underground and aerial encroachments in the right-of-way of 1201 Church Street (Proposal No. 2015M-030EN-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-121

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon easement rights previously retained by Council Ordinance No. 084-343 for property located at 921 31st Avenue North between Alley No. 1180 and Clare Avenue (Proposal No. 2016M-002ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-122

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Alley Number 815, right-of-way and easement (Proposal No. 2015M-024AB-001). The bill was approved by the Planning Commission and the Traffic and Parking Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical, Public Works, and Traffic, Parking and Transportation Committees by a voice vote of the Council.

BILL NO. BL2015-44

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to SP zoning for property located at 5807 Mackie Place, approximately 465 feet east of Ethel Street (0.27 acres), to permit up to 3 residential units, all of which is described herein (Proposal No. 2015SP-082-001). The bill was approved by the Planning Commission with conditions, disapproved without. The Planning, Zoning, and Historical Committee recommended indefinite deferment at the request of the sponsor. Ms. Roberts moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-81

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to RM20-A zoning for properties located at Bellefield Avenue (unnumbered) and 3724 Clarksville Pike, east of Clarksville Pike (9.2 acres), all of which is described herein (Proposal No. 2015Z-087PR-001). The bill was disapproved by the Planning Commission. Mr. Hastings offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2015-81

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to SP zoning for properties located at Bellefield Avenue (unnumbered) and 3724 Clarksville Pike, east of Clarksville Pike (9.2 acres), to permit a maximum of 184 units, all of which is described herein (Proposal No. 2015Z-087PR-001). The bill was disapproved by the Planning Commission. The bill was deferred by the Planning, Zoning, and Historical Committee. Mr. Hastings moved to defer the bill and re-refer to the Planning and Zoning Committee, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-99

An ordinance amending Chapter 2.132 of the Metropolitan Code of Laws by eliminating the term limits of members of the Metropolitan Human Relations Commission. The Personnel, Public Information, Human Relations, and Housing Committee recommended deferment. Ms. Murphy moved to defer the bill, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-100

An ordinance amending Section 16.04.070 of the Metropolitan Code of Laws to require the director of the Metropolitan Department of Codes Administration to notify the Metropolitan Council of all building permits and applications under Section 16.28.010. The Codes, Fair, and Farmers Market Committee recommended deferment to the second meeting in March. Mr. Hagar moved to defer the bill to the second meeting in March, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-101

An ordinance providing the honorary designation of “The Francis S. Guess connector” to a portion of 28th Avenue North. The bill was approved by the Public Works Committee. Mr. Kindall moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-102

An ordinance authorizing the Director of Public Property Administration to execute a quitclaim deed for any property interests the Metropolitan Government may have in a portion of the right of way of Briley Parkway, north of Two Rivers Parkway, and accepting consideration for same in the amount of $68,500.00 (Proposal No. 2016M-001AB-001). The bill was approved by the Planning Commission, Budget and Finance, Planning, Zoning, and Historical and Public Works Committees. Mr. Syracuse moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-103

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and to accept new sewer main and easement for four properties located along Franklin Pike (MWS Project No. 15-SL-207 and Proposal No. 2015M-058ES-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees. Mr. Sledge moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning for property located at 1436 Lischey Avenue, approximately 150 feet south of Gatewood Avenue (0.37 acres), to permit up to two residential units, all of which is described herein (Proposal No. 2015SP-077-001). The bill was disapproved by the Planning Commission. The Planning, Zoning, and Historical Committee recommended deferment and requested a site plan.
