ORDINANCE NO. BL2015-91

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water main and easements, and to accept new and replacement water mains and easements for properties located along Priest Road, East Ashland Drive, Maplemere Drive, Priest Drive and Otter Valley Lane, (MWS Project No. 15-WG-0038 and Proposal No. 2015M-055ES-001).

WHEREAS, the abandonment of approximately 670 linear feet of existing eight inch water main and easement, the abandonment of approximately 5400 linear feet of six inch water main, the acceptance of 670 linear feet of six inch D.I.P. water main and easements, and the acceptance of approximately 500 linear feet of eight inch D.I.P. water main and the replacement of approximately 1330 linear feet of six inch D.I.P. and 4100 linear feet of eight inch D.I.P. on property located at 2026 Priest Road, 2036 Priest Road, East Ashland Drive, Maplemere Drive, Priest Drive and Otter Valley Lane, are needed to construct project number 15-WG-0038; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-055ES-001 on October 28, 2015, for the abandonment and acceptance of said water mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 670 linear feet of existing eight inch water main and easement, to abandon approximately 5400 linear feet of six inch water main, to accept 670 linear feet of six inch D.I.P. water main and easements, and to accept approximately 500 linear feet of eight inch D.I.P. water main and the replacement of approximately 1330 linear feet of six inch D.I.P. and 4100 linear feet of eight inch D.I.P. for properties located at 2026 Priest Road, 2036 Priest Road, East Ashland Drive, Maplemere Drive, Priest Drive and Otter Valley Lane, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
