ORDINANCE NO. BL2015-92

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and easements and to accept a new water main, sewer main and easements for properties located along Woodland and Russell Streets (MWS Project Nos. 15-SL-145 & 15-WL-99 and Proposal No. 2015M-057ES-001).

WHEREAS, the abandonment of approximately 595 linear feet of existing 21 inch combined sewer main and any easements associated with this main, the acceptance of approximately 481 linear feet of 30 inch combined sewer main, four manholes and easements, and the acceptance of approximately 16 linear feet of a 6 inch water main for properties located at 412 and 418 Woodland Street and 417 Russell Street, are needed to construct project number 15-SL145 & 15-WL-99; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-057ES-001 on October 28, 2015, for the abandonment and acceptance of said water and sewer main and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is hereby authorized to abandon approximately 595 linear feet of existing 21 inch combined sewer main and any easements associated with this main, to accept approximately 481 linear feet of 30 inch combined sewer main, four manholes and easements, and to accept approximately 16 linear feet of a six inch water main for properties located at 412 and 418 Woodland Street and 417 Russell Street as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
