Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Father Edward Steiner of Cathedral of the Incarnation.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Cooper, Gilmore, Mendes, Hurt, Shulman, Greene, Hastings, Haywood, Scott Davis, Withers, Anthony Davis, VanReece, Pardue, Hagar, Glover, Huezo, Rhoten, Syracuse, Freeman, Sledge, Allen, O’Connell, Roberts, Kindall, Weiner, Mina Johnson, Murphy, Pulley, Elrod, Blalock, Vercher, Karen Johnson, Potts, Bedne, Dowell, Coleman, Henderson, Rosenberg and Briley (39); Absent: Swope, Pridemore (2).

The Minutes of the regular meeting of November 3, 2015 were approved.

The President announced vacancies in the offices of Public Administrator and Public Trustee for four-year terms, which appointments are made by the Metropolitan Council pursuant to state law. Nominations must be filed with the Metropolitan Clerk not later than 4:00 p.m. on Tuesday, November 24, 2015 and an election to fill the offices will be conducted at the meeting of December 1, 2015.

- ELECTIONS AND CONFIRMATIONS -

Civil Service Commission
Appointment of Mr. Ethan Link for a term expiring March 31, 2019. Mr. Link will fill the unexpired term of Mr. Michael Allen. The Rules-Confirmations-Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electrical Examiners and Appeals Board
Appointment of Ms. Pamela Wyatt for a term expiring October 19, 2019. The Rules-Confirmations-Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Health
Appointment of Dr. Tom Campbell for a term expiring July 9, 2016. Dr. Campbell will fill the unexpired term of Dr. Alicia Batson. The Rules-Confirmations-Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Development and Housing Agency
Reappointment of Mr. Jimmy Granbery for a term expiring November 5, 2020. The Rules-Confirmations-Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Procurement Standards Board
Appointment of Mr. Don Hardin for a term expiring July 20, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2015-50

A resolution exempting Crumb de la Crumb at 160 Belle Forest Circle from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee. Ms. Weiner requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2015-52

A resolution accepting a grant from the Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Emergency Management, to subsidize the Emergency Management Program. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-53

A resolution to appropriate grant funds from the AARP Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Farmers’ Market, for reimbursement of redeemed incentive tokens used to increase the purchase and consumption of fruits and vegetables by low-income consumers. The resolution was approved by the Budget and Finance and Codes, Fair and Farmers Market Committees.

RESOLUTION NO. RS2015-54

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to implement and coordinate activities and services related to HIV/AIDS prevention, surveillance, and sexually transmitted disease services. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-55

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Vanderbilt University, acting by and through the School of Medicine, to participate as a member site in the CDC Tuberculosis Trials Consortium studies. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-56

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish career services for eligible adults, youth, and dislocated workers with barriers to employment, education, training, and support services (LW09F161DSLWK16). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Relations-Housing Committees.

RESOLUTION NO. RS2015-57

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish career, training, and support services for adults (LW09F161ADULT16). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Relations-Housing Committees.

RESOLUTION NO. RS2015-58

A resolution approving an application for the Stones River Greenway – Opry Mills Connector Grant from the Tennessee Department of Transportation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to provide a greenway trail connection between the Stones River Greenway and Cumberland River Pedestrian Bridge to the Opry Mills entertainment complex. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-60

A resolution approving an intergovernmental agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the acceptance of highway improvements in connection with construction at S.R. 112 - Clarksville Highway from S.R. 12 to S.R. 155, State Project No. 19046-2214-14, Federal Project No. STP-112(6), PIN No. 103764.00. The resolution was approved by the Public Works Committee.

RESOLUTION NO. RS2015-61

A resolution approving an intergovernmental agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the acceptance of highway improvements in connection with construction at S.R. 11, US-31A, Nolensville Road from South of Burkitt Road near S.R. 254, Old Hickory Boulevard, State Project No. 19028-2242-14, Federal Project No. STP/NH-11(43), PIN No. 1105766.00. The resolution was approved by the Public Works Committee.

RESOLUTION NO. RS2015-62

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2015-59

A resolution authorizing the Metropolitan Government of Nashville and Davidson County to enter into an agreement with the City of Belle Meade to permit the City of Belle Meade’s Police Department to exercise the law enforcement authority of a Metro Parks Police Officer in Parmer Park. The resolution was approved by the Parks, Library and Recreation and Public Safety-Beer and Regulated Beverages Committees with an amendment. Ms. Mina Johnson offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2015-63

A resolution requesting the President of the United States, Barack Obama, Senate Majority Leader Mitch McConnell, the United States Senate, Speaker of the House Paul Ryan, the United States House of Representatives, and the Tennessee Congressional Delegation to oppose the TransPacific Partnership (TPP). The resolution was approved by the Rules-Confirmations-Public Elections Committee. Mr. Bedne moved to adopt the resolution, which motion was seconded. After discussion, Mr. Pardue called for the previous question, which motion was seconded and adopted by a voice vote of the Council. The bill was approved by the Planning Commission. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Glencliff Court Stormwater Improvement Project for four properties located at 716, 720, 724, and 728 Glencliff Court (Project No. 15-SWC-098 and Proposal No. 2015M-051ES-001). An ordinance approving a License Agreement between the Metropolitan Government of Nashville and Davidson County and the State of Tennessee, acting through its Commissioner of Transportation, authorizing the installation and operation of the Cayce Landing Riverfront Park Project on a portion of certain property owned by the State of Tennessee, lying beneath the I-24 bridge on the South margin of Davidson Street (Proposal No. 2015M-037PR-001). An ordinance authorizing Hunter Marine Transport, LLC, located at 525 Basswood Avenue and 6614 Robertson Avenue, to install, construct and maintain an underground and structural encroachment in the right-of-way of Robertson Avenue (Proposal No. 2015M-019EN-001). BILL NO. BL2015-40

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon easement rights that were previously retained by Council Bill No. O61-224 for property located at 722 Croley Drive (Proposal No. 2015M-043ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Ms. Roberts moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-45

An ordinance amending section 2.24.250 of the Metropolitan Code concerning the disposition of certain properties acquired through the delinquent tax-sale process. The Budget and Finance Committee recommended the bill be deferred. Ms. Weiner moved to defer the bill to the second meeting in December, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-46

An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before July 8, 2015. The bill was approved by the Rules-Confirmations-Public Elections Committee. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-47

An ordinance authorizing the acquisition of certain right-of-way easements, drainage easements, temporary construction easements, and property rights by negotiation or condemnation for use in public projects of the Metropolitan Government for Old Hickory Boulevard at Lakeshore Drive/Pitts Avenue Traffic Signal, Project Number 2015-R-5 (Proposal No. 2015M-049ES-001).
The bill was approved by the Planning Commission, Planning, Zoning and Historical and Public Works Committees. Mr. Hagar moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.
