The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Vice Mayor David Briley.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- MAYOR’S MESSAGE -

Mayor Megan Barry addressed the Metropolitan Council with the following statement:

Good evening. Before I talk about the four years ahead of us, I want to express my condolences to Councilman Colby Sledge, whose mother-in-law passed away today. We’re thinking of Colby and Lindsey and the rest of their family tonight. I also want you to know that, just as we greatly appreciated the help we received from other cities and counties after the terrible flood in 2010, we’ve sent some of our swift water rescue teams to Columbia, South Carolina, this week. The Nashville Fire Department and the Office of Emergency Management sent 15 emergency responders, two rescue boats and other equipment to help respond to the flooding there. I know we’re all thinking of the people of South Carolina and North Carolina right now. Thank you, Vice Mayor Briley, for welcoming me here, and thank you to all of you on the Metro Council who have stepped up to serve our community. You all work incredibly hard – but if you’re like me, you also find it very meaningful. For eight years, I sat where you are now sitting. Specifically, for the last four years I sat where Councilman Cooper sits. It was my experience, Councilman, that the cameras don’t come over that far – so you’ll have to move your chair closer to Council Member Gilmore when you talk if you want the viewers at home to see you. Tonight you will consider many pieces of legislation, and one of the actions before you is to consider the nomination of Jon Cooper as the next Metro Law Director and to approve his nomination. I hope you will do so. I’ve asked Jon to join my administration to help us faithfully implement the laws we’ve adopted in previous years as well as those you all will pass in the coming years. Jon will still be here with you the first and third Tuesday nights; if approved, he’ll just be in a different seat. I also want to thank you for letting me bring Elease Waller with me into the Mayor’s Office as my Executive Assistant. I relied quite a lot on Elease’s knowledge and abilities when I served on the Council, and I’m looking forward to using her talents in my new role. As I said at our swearing-in on September 25th, I won’t govern alone. I look to all of you as strong allies in our future progress. I will rely on each of you in the coming months and years as we work together on a common agenda for the city of Nashville. I have begun meeting with each of you, and I look forward to more conversations. I know that one of the issues that is much talked about – either during your first term or in your recent campaign – was the lack of sidewalks in your districts. Many of you know that the city’s Strategic Sidewalk Master Plan was last updated in 2008. We need to update that plan. My administration has directed Metro Public Works to immediately start undertaking a thorough update so it can develop the best sidewalk plan for our city going forward. Walking is one of the many forms of transportation that any city needs to take into account, and I believe this initiative will make Nashville much more walkable, adding significantly to our quality of life. There are other important issues coming down the pike that will require our joint efforts. Last week, you received a letter from me discussing the need to postpone the implementation of new guidelines related to the local-hire amendment that voters approved. When we did that, it was not in opposition to the amendment – quite the opposite, actually. I believe that if we want to succeed in our mission to hire and train more Davidson County workers on jobs funded by their tax dollars, we must get the implementation right the first time. That is why I want to engage you in the process of crafting the rules and guidelines necessary to make this charter amendment as effective as it can be. At the same time, we need to ensure that it does not hinder our ability as a city to move forward on important projects like building new schools and other large infrastructure. I believe we can do this in a way that builds on the successes of other cities and becomes a model for the nation in how urban areas address issues such as unemployment, under-employment and poverty. With this work, we can empower our citizens to improve their lives in long-lasting ways. There are many other areas where your support and guidance can help to strengthen our city. Appointments to Boards and Commissions are key, and I welcome your recommendations as we have vacancies. I want to make sure our boards and commissions reflect the great diversity of our city, and your input and suggestions can be extremely helpful to finding people who might not otherwise have thought about serving.
As we go forward, if you have names and suggestions for people you think would be good choices to fill these positions, please let me know so that we can pull in the best and the brightest from all across our city to help with the business of governing. I don’t want to take up too much of your time, because I know you’re eager to get down to the business of governing, too. So I will leave you with this. Nashville has some exciting times ahead of us, and I believe that if we work together to meet our common challenges and exceed our shared goals, we can build a better quality of life for ALL of the residents of Davidson County. After all, that IS what the voters sent us here to do. Thank you.

- REPORTS ON MATTERS OTHER THAN LEGISLATION -

Mr. Shulman moved that the Council adopt as temporary rules of procedure those rules in effect at the end of the last term until permanent rules are adopted, which motion was seconded and adopted by a unanimous vote of the Council.
Mr. Shulman moved that the Council shall meet on the first and third Tuesdays of each month at 6:30 p.m., which motion was seconded and adopted by a unanimous vote of the Council.

- ELECTIONS AND CONFIRMATIONS -

Vice Mayor Briley announced that the election of a President Pro Tempore, chairs of the Planning, Zoning and Historical Committee and the Traffic and Parking Committee, and two members of the Council to the Metropolitan Audit Committee will be held at the next meeting of the Council.

Industrial Development Board
Notice was given by the President of four vacancies on the Industrial Development Board of the Metropolitan Government, which vacancies by law are to be filled by the Council. Nominations will be taken at the meeting of October 20, 2015, and an election held to fill the vacancies on November 3, 2015.

Director of Law
Appointment of Mr. Jon Cooper for term set by Charter. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2015-1

A resolution approving Amendment One to a grant from the Davidson County Mental Health and Veteran’s Court Assistance Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County General Sessions Court, Division II, to fund a Veteran’s Court for eligible veteran defendants for evaluations and treatment. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-2

A resolution accepting a grant from the Davidson County Mental Health and Veteran’s Court Assistance Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County General Sessions Court, Division II, to fund a Veteran’s Court for eligible veteran defendants to receive assessment and orientation, stabilization, rehabilitation, and aftercare. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-3

A resolution approving an application for the 2015 Homeland Security Grant from the State of Tennessee, Tennessee Emergency Management Agency, to The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-4

A resolution accepting the Edward Byrne Memorial Justice Assistance Grant (JAG) from the United States Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for technology upgrades, supplies for direct support to basic police, in-service, and specialized training. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-5

A resolution approving Amendment Two to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund an ongoing program to protect air quality to achieve established ambient air standards and protect human health. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-6

A resolution approving three member facility agreements by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health in conjunction with East Public Health Center, Lentz Public Health Center, and Woodbine Public Health Center, and Minnesota Multistate Contracting Alliance for Pharmacy (MMCAP) to purchase vaccines at a discounted rate. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-7

A resolution accepting a Tennessee Cooperative Agreement to Benefit Homeless Individuals (TN-CABHI) Grant which is a jointly funded program from the State of Tennessee, Department of Mental Health, and Substance Abuse Services to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to enhance or develop the infrastructure of Tennessee and the treatment service systems for the population (service recipients). The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-8

A resolution appropriating $250,000 through a grant contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, with Oasis Center, Inc. to provide college access services for the Nashville Scholars Program. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-9

A resolution accepting a grant from the Keep America Beautiful/UPS Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, to reduce levels of carbon dioxide and greenhouse gas emissions through the strategic planting of trees. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2015-10

A resolution approving an application for the 2016 Severe Repetitive Loss Buyout Project Grant from the State of Tennessee, Tennessee Emergency Management Agency, to The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2015-11

A resolution authorizing Spoons, LLC, dba The Farm House, to construct and install an aerial encroachment at 210 Almond Street (Proposal No. 2015M-023EN-001). The resolution was approved by the Planning Commission and Public Works Committee.

RESOLUTION NO. RS2015-12

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Heath Haynes against the Metropolitan Government of Nashville and Davidson County in the amount of $19,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-14

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

A resolution recognizing Mr. Richard Benson, owner of Benson’s Market, Hermitage, Tennessee on the occasion of his retirement. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 212 linear feet of existing water main and easement and to accept 232 linear feet of 10 inch water main with two fire hydrant assemblies for property located at 100 French Landing Drive (MWS Project No. 15-WL-81 and Proposal No. 2015M-045ES-001). The bill was approved by the Planning Commission. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 82 linear feet of existing eight inch sanitary sewer main and 1,341 linear feet of six inch sewer force main, the existing Farmingham Woods Pumping Station, and easements, and to accept the following sanitary sewer mains: 213 linear feet of 15 inch DIP, 1,414 linear feet of 15 inch PVC, 82 linear feet of 12 inch DIP, 20 linear feet of 12 inch PVC, and 39 linear feet of eight inch PVC for property located at Tulip Grove Road (unnumbered) (MWS Project No. 15-SL-184 and Proposal No. 2015M-046ES-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon and replace approximately 220 feet of 15 inch public storm sewer main and easement, to install and accept approximately 270 feet of 36 inch public storm sewer main, to abandon approximately 85 feet of eight inch clay public sewer main, to replace approximately 214 feet of eight inch clay public sewer main, to install and accept approximately 281 feet of eight inch DIP public sewer main and 235 square feet of easement for sanitary sewers and storm drainage for property located at 2213 11th Avenue South (MWS Project No. 15-SWC-139 & 15-SC-93 and Proposal No. 2015M-034ES-001). The bill was approved by the Planning Commission. BILL NO. BL2015-11

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to construct approximately 161 linear feet of eight inch PVC sanitary sewer main, install two sanitary sewer manholes, and replace/relocate one fire hydrant for property located at 2016 Beech Avenue (MWS Project Nos. 15-SL-22 and 15-WL-24 and Proposal No. 2015M-037ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 475 linear feet of existing eight inch sanitary sewer main and 385 linear feet of an existing six inch water main and to accept 839 linear feet of eight inch DIP sanitary sewer line with five manhole units and 971 linear feet of six inch water main for property located at 1034 West Eastland Avenue (MWS Project Nos. 15-SL-27 and 15-WL-29 and Proposal No. 2015M-041ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2015-13

An ordinance amending Chapters 17.08 and 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations, designating “mineral extraction” as a use permitted with conditions in the IG zoning district and adding conditions applicable to this use, all of which is more particularly described herein (Proposal No. 2015Z-016TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2015-14

An ordinance amending Chapters 17.08 and 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations, establishing “asphalt plant” and “concrete plant” as uses permitted with conditions in the IG zoning district and adding conditions applicable to these uses, all of which is more particularly described herein (Proposal No. 2015Z-017TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2015-15

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to RM20-A zoning for property located at 104 Lucile Street, approximately 190 feet east of Dickerson Pike (0.28 acres), all of which is described herein (Proposal No. 2015Z-072PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2015-16

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS15 to SP zoning for properties located at 2237 Seven Points Circle and 4103 and 4109 Smotherman Lane, approximately 1,500 feet north of Stewarts Ferry Pike (32.06 acres), to permit up to 86 residential units on 45 lots, all of which is described herein (Proposal No. 2015SP-075-001). The bill was approved by the Planning Commission with conditions, disapproved without. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 and R6 to CS-A zoning for properties located at 4408 Nolensville Pike and 339 Alice Avenue, at the northeast corner of Alice Avenue and Nolensville Pike (0.32 acres), all of which is described herein (Proposal No. 2015Z-074PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2015-18

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to OR20-A zoning for property located at Nolensville Pike (unnumbered), at the southeast corner of Nolensville Pike and Lenox Creekside Drive (1.39 acres), all of which is described herein (Proposal No. 2015Z-060PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2015-19

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from ORI-A to SP zoning for properties located at 121 A, 121 B, 121 C, 123 and 125 30th Avenue South and 3022 Vanderbilt Place, at the northwest corner of 30th Avenue South and Vanderbilt Place (0.92 acres), to permit a 12 story office building, all of which is described herein (Proposal No. 2015SP-085-001). The bill was approved by the Planning Commission with conditions, disapproved without. SUBSTITUTE BILL NO. BL2015-25

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Hillsboro Village UDO to add text to the Building Façade standard, for all subdistricts, to reflect appropriate window and door opening orientation and alignment, and to add a definition of a mezzanine and a requirement that mezzanines are to be counted as an individual story (26.91 acres), all of which is described herein (Proposal No. 2005UD-009-004). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.
