Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by State Representative Johnny Shaw.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

President Pro Tempore Matthews presided in the absence of Vice Mayor Neighbors.

- ELECTIONS AND CONFIRMATIONS -


Metropolitan Action Commission
Reappointment of Ms. Benita Davis for a term expiring February 2, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Arts Commission
Reappointment of Ms. Jane Alvis for a term expiring January 1, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education, Community & Arts Television Corporation (NECAT)
Appointment of Mr. Mike Kopp for a term expiring February 5, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Without objection BL2015-1009 was taken out of order.

BILL NO. BL2015-1009

An ordinance amending Title 6 of the Metropolitan Code of Laws to add a new Chapter 6.83 pertaining to the hours of operation for cash advance, check cashing, and title loan establishments. The bill was disapproved by the Codes, Fair and Farmers Market Committee. Mr. Holleman offered Amendment No. 1 and moved for its adoption, which motion was seconded. After discussion, Mr. Glover called for the previous question, which motion was seconded and adopted by a by a voice vote of the Council. The amendment was adopted by a roll call vote of the Council. Mr. Holleman moved to pass the bill on second reading as amended, which motion was seconded. Mr. Garrett filed documents for the record. After discussion, Mr. Mitchell called for the previous question, which motion was seconded and was adopted by a voice vote of the Council. An ordinance approving Amendment No.3 to the Five Points Redevelopment Plan (Proposal No. 2014M-005OT-001). The bill was approved by the Planning Commission. Mr. Westerholm requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Westerholm moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-949

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to R6 for properties located at 1103 and 1105 Holly Street, approximately 60 feet east of South 11th Street and located within the Lockeland Springs-East End Neighborhood Conservation Overlay and the Five Points Redevelopment District (0.42 Acres), all of which is described herein (Proposal No. 2014Z-065PR-001).

BILL NO. BL2014-950

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to R6 for properties located at 1101 and 1103 Shelby Avenue, at the northeast corner of Shelby Avenue and South 11th Street and located within the Lockeland Springs-East End Neighborhood Conservation Overlay and the Five Points Redevelopment District (0.36 Acres), all of which is described herein (Proposal No. 2014Z-066PR-001).

Mr. Westerholm moved to defer the bills indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-1000

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5 to SP zoning for property located at 1126 Shelton Avenue, at the southwest corner of Shelton Avenue and Windsor Avenue, (0.31 acres), to permit up to three detached residential dwelling units, all of which is described herein (Proposal No. 2014SP-077-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Anthony Davis requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Davis moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R40 to SP zoning for property located at 2001 Woodmont Boulevard, at the southwest corner of Woodmont Boulevard and Benham Avenue, (2.36 acres), to permit physical therapy, medical office and associated uses in the existing building, all of which is described herein (Proposal No. 2014SP-019-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. McGuire requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. BILL NO. BL2015-1005

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS40 to SP zoning for property located at 5704 Old Harding Pike and to amend a portion of the property rezoned by Council Bill BL2013-630 located at 6030 B Sedberry Road, approximately 230 feet south of Sedberry Road, (0.57 acres), to up to four detached residential units, all of which is described herein (Proposal No. 2013SP-041-003). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Evans requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Evans moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-1006

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, by changing from R40 to SP zoning for various properties located along Church Street East, Valley View Road, and Cloverland Drive, at the northwest corner of the Church Street East and Cloverland Drive intersection (17.58 acres), to permit up to 78 single family residential units, all of which is described herein (Proposal 2015SP-011-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Banks requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of an in opposition to passage of the bill. The President declared the public hearing closed. Mr. Banks moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2015-1370

A resolution authorizing the execution, terms, issuance, sale and payment of general obligation refunding bonds in multiple series in an aggregate principal amount of not to exceed $261,000,000. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-1372

A resolution approving an application for an Our Town grant from the National Endowment for the Arts to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Arts Commission in conjunction with Lipscomb University’s Andrews Institute of Civic Leadership, to create a THRIVE Learning Lab to jumpstart artistic, social, and place-making practices in the community. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-1373

A resolution accepting a grant from the Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Emergency Management, to fund costs related to homeland security preparedness activities associated with implementing the Tennessee State Homeland Security Strategies and National Preparedness Goals. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-1374

A resolution authorizing the Director of Public Property to exercise an option to purchase real property to be used by Metropolitan Parks and Recreation as a park (Proposal No. 2015M-003PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Parks, Library and Recreation and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2015-1375

A resolution approving an application for a Big Band Dances Grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Parks and Recreation Department. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-1377

A resolution accepting a package of grants from the Friends of Warner Parks to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to provide staffing for Warner Parks Center, Nature Center support, and the SWEAT Program for additional labor for summer maintenance. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-1378

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Educare Childcare and Enrichment Center #2 to perform activities related to the Project Diabetes Golden Sneaker Initiative Program. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2015-1379

A resolution approving Amendment Two to a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide personal care services, homemaker services, and Nutrition HCBS (Home and Community Based Services) to eligible clients under the options program. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1380

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare eligible participants for re-entry into the labor force and to offer training to those facing serious barriers to productive employment (LW09F151IWRSP-15). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees.

RESOLUTION NO. RS2015-1381

A resolution accepting a Used Oil Collection Grant from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, to establish a used oil collection site at the Ezell Pike Convenience Center. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2015-1382

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claims of Eeva-Liisa Moran and David Moran against the Metropolitan Government of Nashville and Davidson County in the amount of $35,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1316

A resolution appropriating one hundred thousand dollars ($100,000) from the Undesignated Fund Balance of the General Fund of the General Services District to Neighborhoods Resource Center to provide partial funding for its program services. The Budget and Finance Committee recommended withdrawal. Mr. Scott Davis moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2015-1371

A resolution amending Resolution No. RS2013-710 pertaining to capital funds for the Bus Rapid Transit – East West Connector (“the AMP”) project. The resolution was approved by the Budget and Finance Committee. RESOLUTION NO. RS2015-1376

A resolution appropriating $24,999.95 from the Reserve for Community Garden Program account of the General Fund of the General Services District to various schools and nonprofit organizations for community garden programs. BILL NO. BL2015-1015

An ordinance amending Section 16.24.340 of the Metropolitan Code pertaining to the posting of street address numbers on residential mailboxes. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2015-1016

An ordinance amending Chapter 16.28 of the Metropolitan Code to require building and demolition permit holders for major projects to post a sign on the property providing information about the development. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2015-1017

An ordinance repealing Ordinance No. O89-1011, as amended, and approving the revocation and deletion of the Five Points Redevelopment Plan. Mr. Tygard moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-1018

An ordinance approving a Lease Agreement by and between the Metropolitan Government of Nashville and Davidson County and Nashville Classical, Inc. (Proposal No. 2015M-002PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Education and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2015-1019

An ordinance authorizing the Director of Public Property Administration, or his designee, to execute the attached special warranty deed from the Metropolitan Government conveying to the State of Tennessee a portion of two parcels of land at the northwest corner of 38th Avenue North and Charlotte Avenue, totaling 0.179 acres (Proposal No. 2014M-031PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2015-1020

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Alley No. 160 right-of-way (Proposal No. 2014M-015AB-001). The bill was approved by the Planning Commission and Traffic and Parking Commission. BILL NO. BL2015-1021

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County to acquire right of way easements, drainage easements, temporary construction easements and property rights by negotiation or condemnation, for use in public projects of the Metropolitan Government, initially for purposes of Public Works Department Project Number 2014-R-6, Lealand Lane and Kirkwood Avenue Sidewalk Improvements (Proposal No. 2015M-004ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2015-1022

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 700 linear feet of eight inch public sewer main and easement and 400 linear feet of existing water main, to abandon and remove 429 linear feet of six inch DIP water main and replace said water main with eight inch DIP in the same trench, to accept 100 linear feet of six inch DIP water main for fire hydrant leads and existing main re-connects (three fire hydrants), to abandon 65 linear feet of six inch DIP water main in Elkins Avenue (currently not connected to 12”) and to abandon 65 linear feet of six inch DIP water main (to be connected to 12” water main) located on various properties south of Charlotte Avenue (MWS Project Nos. 14-SL-29 & 14-WL-22 and Proposal No. 2015M-002ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to SP zoning for properties located at 1614 and 1616 4th Avenue North, approximately 115 feet south of Garfield Street, (0.4 acres), to permit up to seven detached residential dwelling units, all of which is described herein (Proposal No. 2014SP-079-001). The bill was approved by the Planning Commission with conditions and disapproved without. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS20 to RS30 zoning for property located at 4008 Iroquois Avenue, approximately 600 feet east of Lynwood Boulevard (1.23 acres), all of which is described herein (Proposal No. 2015Z-009PR-001).

BILL NO. BL2015-1025

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS15 to SP zoning for property located at 5572 South New Hope Road, at the current terminus of Cherry Bark Court, (3.52 acres), to permit up to 13 single-family dwelling units, all of which is described herein (Proposal No. 2015SP-006-001). The bill was disapproved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2015-1026

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for property located at 1618 4th Avenue North, at the southeast corner of 4th Avenue North and Garfield Street, (0.40 acres), to permit up to eight residential dwelling units, all of which is described herein (Proposal No. 2015SP-002-001). The bill was approved by the Planning Commission with conditions and disapproved without. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon easement rights that were previously retained by Council Bill No. BL2006-930 within a portion of 11th Avenue South right-of-way between Laurel Street and the north right-of-way margin of Pine Street and 11th Avenue South between the south right-of-way margin of Pine Street and 12th Avenue South and also abandoning the easement rights that were previously retained by that bill within a portion of 11th & 12th Avenue South right-of way at the southwest corner of the intersection (Proposal No. 2015M-007ES-001). An ordinance amending Title 3, Chapter 3.30 of the Metropolitan Code relative to employee benefits in order to comply with federal requirements for qualified plans.
