ORDINANCE NO. BL2015-1011

An ordinance approving a Lease Agreement by and between The Metropolitan Government of Nashville and Davidson County and STEM Preparatory Academy (Proposal No. 2014M-032PR-001).

WHEREAS, Ordinance BL2013-405 approved a sublease agreement between Metro and STEM Preparatory Academy permitting STEM to use a portion of the leased property at 1250 Foster Avenue, better known as the Tennessee Preparatory School (TPS), for a certified charter school serving fifth- through eithth-grade students residing in the South Nashville area; and,

WHEREAS, Ordinance BL2013-594 authorized Metro to acquire a portion of the TPS property thereby becoming the owner of the same real property previously subleased by Metro to STEM; and,

WHEREAS, Metro now wishes to replace the previously approved sublease with a new lease agreement which includes the facility in the sublease and expands it to also incorporate the use of the Field House and adjacent grounds.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The lease agreement between the Metropolitan Government of Nashville and Davidson County and STEM Preparatory Academy, which is attached hereto and incorporated by reference, is hereby approved and the Directors of the Department of General Services and Public Property Administation are authorized to execute the lease on behalf of the Metropolitan Government.

Section 2. Any amendment, change, or extension to the lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. That the Director of the Department of General Services shall have authority to approve any and all renovations and/or improvements to the leased premises as may be proposed by and for STEM Preparatory Academy.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
