ORDINANCE NO. BL2015-1022

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 700 linear feet of eight inch public sewer main and easement and 400 linear feet of existing water main, to abandon and remove 429 linear feet of six inch DIP water main and replace said water main with eight inch DIP in the same trench, to accept 100 linear feet of six inch DIP water main for fire hydrant leads and existing main re-connects (three fire hydrants), to abandon 65 linear feet of six inch DIP water main in Elkins Avenue (currently not connected to 12”) and to abandon 65 linear feet of six inch DIP water main (to be connected to 12” water main) located on various properties south of Charlotte Avenue, (MWS Project Nos. 14-SL-29 & 14-WL-22 and Proposal No. 2015M-002ES-001).

WHEREAS, the abandonment of approximately 700 linear feet of eight inch public sewer main and easement and 400 linear feet of existing water main, the abandonment and removal of 429 linear feet of six inch DIP water main and replacement with eight inch DIP in the same trench, the acceptance of 100 linear feet of six inch DIP water main for fire hydrant leads and existing main re-connects (three fire hydrants), the abandonment of 65 linear feet of six inch DIP water main in Elkins Avenue (currently not connected to 12”) and the abandonment of 65 linear feet of six inch DIP water main (to be connected to 12” water main) located on various properties south of Charlotte Avenue are needed to construct project number 14-SL-29 and 14-WL-22; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-002ES-001 on December 18, 2014 for the abandonment and acceptance of said sewer and water mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 700 linear feet of eight inch public sewer main and easement and 400 linear feet of existing water main, to abandon and remove 429 linear feet of six inch DIP water main and replace said water main with eight inch DIP in the same trench, to accept 100 linear feet of six inch DIP water main for fire hydrant leads and existing main re-connects (three fire hydrants), to abandon 65 linear feet of six inch DIP water main in Elkins Avenue (currently not connected to 12”) and to abandon 65 linear feet of six inch DIP water main (to be connected to 12” water main) located on various properties south of Charlotte Avenue, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
