RESOLUTION NO. RS2015-1374

A resolution authorizing the Director of Public Property to exercise an option to purchase real property to be used by Metropolitan Parks and Recreation as a park ( Proposal No. 2015M-003PR-001).

WHEREAS, pursuant to the terms of the agreement attached hereto and incorporated herein as Exhibit 1 to this resolution, the Tennessee Parks & Greenways Foundation has agreed to sell to the Metropolitan Government certain unimproved real property known as 402 Hathaway Court in Nashville; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council; and,

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (Exhibit 1) to acquire real property located in Davidson County being known as Davidson County Tax Map No. 129-05, Parcel 005.00, as approximately shown on Exhibit 2 and incorporated into this resolution by reference; and,

WHEREAS, the Board of Parks and Recreation has considered and approved the acceptance of the Property; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the purchase of said property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. That the Director of Public Property, or his designee, is hereby authorized to exercise the option to purchase the property (a portion of Davidson County Tax Map 129-05-0 Parcel 005.00) as approximately shown in Exhibit 2 and to execute the necessary documents pertaining thereto.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
