ORDINANCE NO. BL2015-1019

An ordinance authorizing the Director of Public Property Administration, or his designee, to execute the attached special warranty deed from the Metropolitan Government conveying to the State of Tennessee a portion of two parcels of land at the northwest corner of 38th Avenue North and Charlotte Avenue, totaling 0.179 acres. (Proposal No. 2014M-031PR-001).

Whereas, pursuant to the terms of the special warranty deed attached as Exhibit A to this ordinance, the Metropolitan Government has agreed to transfer to the State of Tennessee all the interest it may possess in a portion of two parcels of property located at the northwest corner of 38th Avenue North and Charlotte Avenue, as are more particularly detailed in Exhibit A, hereto (the Property); and,

Whereas, the citizens of Nashville and Davidson County will benefit through the actions contemplated herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property Administration, or his designee, is authorized to execute the special warranty deed attached hereto as Exhibit A, conveying such interest as the Metropolitan Government may have in the area described in Exhibit A, hereto.

Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2015-1019

Madam President:

I move to amend Ordinance No. BL2015-1019 as follows:

I. By adding the following recital clause:
“Whereas, said conveyance is made in consideration of receipt by The Metropolitan Government of One Hundred Sixty-Seven Thousand Six Hundred Fifty dollars ($167,650.00) from the state of Tennessee.”

II. By deleting Section 1 in its entirety and substituting with the following:
“Section 1. That the Director of Public Property Administration, or his designee, is authorized to execute the special warranty deed attached hereto as Exhibit A, conveying such interest as the Metropolitan Government may have in the area described as Exhibit A, hereto. The Metropolitan Government is hereby authorized to accept the payment of the $167,650.00 from the State of Tennessee as consideration thereof, and the proceeds of said conveyance of said parcels of property shall be credited to fund 40015-GSD FY 15 Capital Projects BU 42402015-Roads.”
