ORDINANCE NO. BL2015-1018

An ordinance approving a Lease Agreement by and between The Metropolitan Government of Nashville and Davidson County and Nashville Classical, Inc. (Proposal No. 2015M-002PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County owns the improved property at 1310 Ordway Place, which formerly housed the Ross Head Start Center and is currently vacant, and

WHEREAS, The Metropolitan Government of Nashville and Davidson County has negotiated a lease agreement with Nashville Classical, Inc. for the operation of a charter school to serve Kindergarten through Eighth grade students, with an initial term of ten (10) years, with two options to extend the lease for an additional five years each, a copy of which is attached hereto; and

WHEREAS, approval of this lease agreement was granted by the Metropolitan Planning Commission on December 26, 2014. and

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this lease agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The lease agreement between the Metropolitan Government of Nashville and Davidson County and Nashville Classical, Inc., which is attached hereto and incorporated by reference, is hereby approved and the Director of Public Property Administation is authorized to execute the lease on behalf of the Metropolitan Government.

Section 2. Any amendment or change to the lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
