ORDINANCE NO. BL2015-1017
An Ordinance repealing Ordinance No. O89-1011, as amended, and approving the revocation and deletion of the Five Points Redevelopment Plan.
WHEREAS, pursuant to Ordinance No. O89-1011, as subsequently amended by Ordinance Nos. O91-1522, and BL2005-510, the Council of the Metropolitan Government of Nashville and Davidson County, Tennessee approved the Five Points Redevelopment Plan (the “Plan”) and
WHEREAS, in addition to reducing blight, the objective of the Plan was in part: (1) to revitalize the Five Points Neighborhood Commercial District; (2) to create an environment conducive to the development and improvement of the Five Points area; (3) to stabilize the residential neighborhoods in the Five Points area; and (4) to enhance the neighborhood preservation goals of the various neighborhoods in the area; and
WHEREAS, the Metropolitan Council has determined that the aforementioned goals, as well as the other objectives stated in the Plan, have been accomplished and the Plan has successfully been implemented; and
WHEREAS, future development in the Five Points District should be regulated by Title 17 of the Metropolitan Code, Zoning Regulations; and
WHEREAS, there is currently no debt outstanding associated with the Five Points Redevelopment Plan, so that funds received from incremental property taxes will no longer go to the Metropolitan Housing Development Agency, but as of the effective date of the approval of this ordinance, will go into the General Fund of the Metropolitan Government.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. O89-1011, as the same has been amended by Ordinance Nos. O9101522 and BL2005-510, is hereby repealed in its entirety.
Section 2. That the Plan is hereby deleted in its entirety and shall be null and void from and after the effective date of this Ordinance.
Section 3. That all future development within the Five Points District shall be regulated by Title 17 of the Metropolitan Code, Zoning Regulations, as the same may be amended from time to time.
Section 4. That this Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
