Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Pastor Michael Joyner of Greater Faith Missionary Baptist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of September 5, 2017 were approved.

PROPOSED RULES AMENDMENT

Proposed amendments to Rules Nos. 11, 15, 17 and 28 of the Rules of Procedure of the Metropolitan Council. The Rules, Confirmations, and Public Elections Committee recommended approval. Ms. Haywood moved to adopt the amendments, which motion was seconded and adopted by a voice vote of the Council.

ELECTIONS AND CONFIRMATIONS

Industrial Development Board
The President called for an election to fill three vacancies on The Industrial Development Board of The Metropolitan Government of Nashville and Davidson County for terms expiring September 19, 2023. Nominations previously made were: Councilmember Allen nominated Ms. Ginger Hausser; Councilmember Pulley nominated Ms. Cristina Allen; Councilmember Scott Davis nominated Dr. Saletta Holloway; Councilmember O’Connell nominated Ms. Lindsey Cox; Councilmember Hurt nominated Mr. Eddie Gray. Mr. Eddie Gray withdrew his name. Ms. Haywood reported that the candidates had been interviewed by the Rules, Confirmation, and Public Elections Committee and all were found qualified to serve.

Agricultural Extension Board
Reappointment of Mr. Mark Kerske for a term expiring August 1, 2020. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Dr. Thelma Sanders-Hunter for a term expiring August 1, 2020. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Corrections Advisory Board
Appointment of Mr. Mike Engle for a term expiring August 31, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Charlotte Mann for a term expiring August 31, 2019. At the request of the Rules, Confirmation, and Public Elections Committee, the confirmation was deferred.

Appointment of Ms. Alyssia Overby for a term expiring August 31, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Jackie Shrago for a term expiring August 31, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historical Commission
Reappointment of Ms. E. Menie’ Bell for a term expiring August 10, 2021. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Dr. C. William (Bill) McKee for a term expiring August 10, 2021. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Development and Housing Agency
Reappointment of Ms. Miniimah Basheer for a term expiring August 10, 2021. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Health and Educational Facilities Board
The President called for nominations to fill two (2) vacancies on the Health and Educational Facilities Board. Councilmember Mendes nominated Sarah Hannah; Councilmember O’Connell nominated Isaac Addae; Councilmember Rosenberg nominated Chris Moth; Councilmember Pulley nominated Sean McGuire; Councilmember Murphy nominated Blake Wilson; Councilmember Henderson nominated Stephen Frohsin; Councilmember Scott Davis nominated Saletta Holloway. There being no further nominations, the President declared the nominations closed. The nominees were referred to the Rules, Confirmations, and Public Elections Committee for a recommendation, and an election will be conducted at the next regular meeting of the Council.

The President called for nominations for Chairs of the Planning, Zoning, and Historical Committee and the Traffic, Parking and Transportation Committee and to members to the Audit Committee. Councilmember Allen nominated Councilmember Bedne for the Planning, Zoning, and Historical Committee; Councilmember Shulman nominated Councilmember Cooper for the Audit Committee; Councilmember Weiner nominated Councilmember Hagar for the Traffic, Parking and Transportation Committee; Councilmember Vercher nominated Councilmember for the Audit Committee. The votes for these positions will be held at the October 3, 2017 Council meeting.

RESOLUTIONS ON PUBLIC HEARING

RESOLUTION NO. RS2017-863

A resolution exempting 51 North Taproom, LLC located at 704 51st Avenue North from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. Ms. Roberts requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. CONSENT AGENDA RESOLUTIONS

RESOLUTION NO. RS2017-864

A resolution authorizing the Director of Public Property, or his designee, to exercise an option agreement for the purchase of two flood-prone properties, for Metro Water Services (MWS Project No. 17WS0001 and Proposal No. 2017M-22PR-003). The resolution was approved by the Planning Commission, Budget and Finance, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2017-872

A resolution granting the Metropolitan Department of Water and Sewerage Services authority to waive grading permits for at grade Metro Greenway’s trail projects and approve buffer disturbances for Metro Greenway’s trail projects constructed by or for the Metropolitan Board of Parks and Recreation. The resolution was approved by the Parks, Library, and Recreation and Public Works Committees.

RESOLUTION NO. RS2017-873

A resolution exempting the construction and/or maintenance of water lines, sanitary sewer lines, and stormwater drainage projects by or for the Metropolitan Department of Water and Sewerage Services from water quality buffer requirements contained in the Metro Stormwater Management Manual, Volume 1. The resolution was approved by the Public Works Committee.

RESOLUTION NO. RS2017-874

A resolution authorizing NP 5th, LLC to construct and install an aerial encroachment at 410 Fifth Ave South for (Proposal No. 2017M-033EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2017-875

A resolution approving an application for the recycling rebate from the State of Tennessee to The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance and Public Works Committee

RESOLUTION NO. RS2017-876

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of James Fletcher against the Metropolitan Government of Nashville and Davidson County in the amount of $8,200.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-877

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Sheila Keeton against the Metropolitan Government of Nashville and Davidson County in the amount of $10,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-878

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for the Internet Crimes Against Children Unit. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-879

A resolution approving Amendment Two(a) to a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, to support the provision of mental health services and criminal justice system advocacy to victims of violent crime. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-880

A resolution accepting a grant from the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Sheriff’s Office, to provide litter pickup along state and county roads, as well as litter prevention education. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-881

A resolution proclaiming October 2017 as Cyber Security Awareness Month in Nashville and Davidson County. The resolution was approved by the Rules, Confirmation, and Public Elections Committee.

RESOLUTION NO. RS2017-882

A resolution requesting and encouraging greater sensitivity and decorum from Nashville news media outlets regarding reports of juvenile deaths. The resolution was approved by the Rules, Confirmation, and Public Elections Committee.

RESOLUTIONS

RESOLUTION NO. RS2017-779

A resolution to amend Ordinance No. BL2016-235 to increase permit fees for closures in the right-of-way permit high impact area. The Budget and Finance and Public Works Committees recommended deferral to the second meeting in December at the request of the sponsor. Mr. Elrod moved to defer the bill to the second meeting in December, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2017-780

A resolution to amend Ordinance No. BL2016-235 to create a fee for a right-of-way site management plan permit. The Budget and Finance and Public Works Committees recommended deferral to the second meeting in December at the request of the sponsor. Mr. Elrod moved to defer the bill to the second meeting in December, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2017-781

A resolution requesting that all fee revenue from right-of-way temporary closure permits be used for staffing, expenses, and other direct costs of administering such permits. The Budget and Finance and Public Works Committees recommended deferral to the second meeting in December at the request of the sponsor. Mr. Elrod moved to defer the bill to the second meeting in December, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2017-859

A resolution requesting that the Metropolitan Department of Public Works prepare a listing of the twenty most congested traffic areas in Nashville and Davidson County, together with adopted or recommended interim steps to address traffic congestion at those locations. Mr. Shulman offered a substitute resolution and moved that it be accepted for filing, which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE RESOLUTION NO. RS2017-859

A resolution requesting that the Metropolitan Department of Public Works prepare a plan for determining a list of the twenty most congested traffic areas in Nashville and Davidson County, and a proposed timetable and strategy steps to address traffic congestion at those locations. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to SP zoning on property located at 905 Cherokee Avenue, west of the terminus of Delmas Avenue (5.94 acres), to permit up to 166 multi-family residential units and 23,700 square feet of non-residential units, all of which is described herein (Proposal No. 2017SP-071-001). An ordinance amending Chapter 2.210 of the Metropolitan Code of Laws relative to Economic and Community Development Incentive Grants. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

An ordinance amending Title 5 of the Metropolitan Code of Laws to establish a merit-based grant program. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
