ORDINANCE BL2017-868

An ordinance amending Section 16.24.190 of the Metropolitan Code of Laws regarding the prosecution for repeat violations of the Property Standards Code.

BE IT ENACTED THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 16.24 of the Metropolitan Code of Laws be and the same is hereby amended by deleting the provisions of Section 16.24.190 and substituting in lieu thereof the following new provisions:

16.24.190 - Prosecution of repeat violation.

Whenever the director determines that there has been a repeat violation of the same regulation, or any other regulation, within this chapter or has grounds to believe that such a repeat violation has occurred, the director shall forego the issuance of a notice of violation and immediately institute the appropriate proceeding at law or in equity to restrain, enjoin, correct or abate such violation, or to require the removal or termination of the unlawful occupancy of the building, structure or premises in violation of this chapter.

Section 2. This Ordinance shall take effect from and after its final passage, the Welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
