RESOLUTION RS2017-873

A resolution exempting the construction and/or maintenance of water lines, sanitary sewer lines, and stormwater drainage projects by or for the Metropolitan Department of Water and Sewerage Services from water quality buffer requirements contained in the Metro Stormwater Management Manual, Volume 1.

WHEREAS, the Metropolitan Department of Water and Sewerage Services (Metro Water Services) provides the citizens of Metropolitan Nashville and Davidson County with safe drinking water, wastewater treatment, and stormwater management, which are vital components of the public infrastructure essential for our health, comfort, and standard of living; and,

WHEREAS, pursuant to Metro Code 2.206.010 the Metropolitan Government of Nashville and Davidson County and all of its various departments, agencies, boards and commissions must comply with all provisions of the Metropolitan Code, unless they are exempt from compliance by resolution requiring twenty-one votes of the metropolitan council for just cause; and,

WHEREAS, pursuant to the Stormwater Management Manual, Volume 1, new development, significant redevelopment, and sites needing a grading permit are required to preserve water quality buffers along Metro’s community waters; and,

WHEREAS, due to the volume and logistics of the construction and/or maintenance of water line, sanitary sewer line, and stormwater drainage projects performed by or for Metro Water Services, and in the interest of providing public resources expeditiously, just cause exists from exempting the construction and/or maintenance of these projects from compliance with the water quality buffer requirements contained in the Stormwater Management Manual, Volume 1; and,

WHEREAS, the construction and/or maintenance of water line, sanitary sewer line, and stormwater drainage projects by or for Metro Water Services will be reviewed and approved by Metro Water Services National Pollutant Discharge Elimination System (NPDES) Office staff to minimize impacts to water quality buffers and any associated drainage features.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the construction and/or maintenance of water line, sewer line, and stormwater drainage projects by or for Metro Water Services are hereby exempt from compliance with the water quality buffer requirements contained in the Stormwater Management Manual, Volume 1 upon approval from the NPDES Office.

Section 2. Projects not approved by Metro Water Services NPDES Office shall apply for a variance with the Stormwater Management Committee.

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
