RESOLUTION RS2017-872

A resolution granting the Metropolitan Department of Water and Sewerage Services authority to waive grading permits for at grade Metro Greenway’s trail projects and approve buffer disturbances for Metro Greenway’s trail projects constructed by or for the Metropolitan Board of Parks and Recreation.

WHEREAS, Metropolitan Department of Water and Sewerage Services (Metro Water Services) administers the grading permit and the water quality buffer requirements in accordance with Volume 1 of the Metro Stormwater Management Manual; and,

WHEREAS, pursuant to Metro Code 2.206.010 the Metropolitan Government of Nashville and Davidson County and all of its various departments, agencies, boards and commissions must comply with all provisions of the Metropolitan Code, unless they are exempt from compliance by resolution requiring twenty-one votes of the metropolitan council for just cause; and,

WHEREAS, at grade Metro Greenway’s trails result in minimal impacts to stormwater quality and quantity considerations; and,

WHEREAS, Metro Greenway’s trails provide public recreational resources and connectivity to the community, provide visual and physical access to Nashville’s waterways, conserve greenspace and scenic viewsheds along Nashville’s waterways, and were an intended use of the water quality buffer; and,

WHEREAS, just cause exists for granting Metro Water Services the authority to waive grading permits for at grade Metro Greenway’s trail projects and approve buffer disturbances for Metro Greenway’s trail projects.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Department of Water and Sewerage Services are hereby granted authority to waive grading permits for at grade Metro Greenway’s trail projects and approve water quality buffer disturbances for Metro Greenway’s trail projects.

Section 2. Metro Greenway’s trail plans will be reviewed and approved by Metro Water Services National Pollutant Discharge Elimination System (NPDES) Office staff to minimize impacts to natural resources and any associated drainage features.

Section 3. Projects not approved by Metro Water Services NPDES Office shall apply for a variance with the Stormwater Management Committee.

Section 4. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
