RESOLUTION RS2017-870

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the reimbursement of railroad crossing safety improvements at Old Glenrose Avenue (0B680), Railroad Crossing #349-216Y, Fed No. HSIP-R00S(310), State No. 19960-2550-94; PIN 123193.00 (Prop. No. 2017M-001AG-001).

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”), has programmed safety funds for the improvements of various railroad crossings throughout Davidson County; and,

WHEREAS, TDOT has directed The Metropolitan Government of Nashville and Davidson County (“Metro”), acting by and through the Department of Public Works, to construct the Railroad Crossing Approaches Project at Old Glenrose Avenue; and

WHEREAS, Metro agrees to cooperate with TDOT as described in said agreement, attached hereto as Exhibit A and incorporated herein by reference, so that said construction can occur; and,

WHEREAS, the project estimate is $10,924.47 and Metro is eligible for 100% reimbursement for the Railroad Crossing Approaches Project under 23 CFR, Subparts 1401 and 646B; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes Metro to approve an agreement with TDOT by resolution; and,

WHEREAS, it is to the benefit of the citizens of Metro that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement with TDOT, attached hereto as Exhibit A and incorporated herein by reference, for railroad crossing safety improvements at Old Glenrose Avenue (0B680), Railroad Crossing #349-216Y, Federal Project No: HSIP-R00S(310), State Project No: 19960-2550-94, PIN No: 123193.00, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
