The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Lionel Greene.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of December 15, 2015 were approved.

- MAYOR’S MESSAGE -

Mayor Megan Barry addressed the Metropolitan Council with the following statement:

Hello everyone. Welcome back and happy New Year! I hope that all of you had a happy, peaceful, and relaxing holiday.
Not too long ago, I sat over there in that seat and at the beginning of each Council meeting, the kind Clerk would be asked – are there any messages from the mayor? Occasionally, Clerk Hall would respond, yes and she would read a bond report and during the eight years I served on Metro Council, the Mayor appeared in person a few times. It became a running joke – will there be any messages this evening?
I promise that I’m not going to come all the time, but I do think it’s important for all of you to hear directly from me on occasion.
This past Sunday marked my first 100 days in the Mayor’s Office and, for 26 of you, it marked your first 100 days on the Metro Council. The other 14 – this is old hat, you already know what to do.
Like you, I’ve been busy. I’ve had the opportunity to appoint a very talented and diverse staff that I think reflects the population of Nashville and my administration is focused on engaging with all of you and with all of our Nashville community.
We’ve got a lot to do in 2016, and I’m looking forward to working with all of you on our shared goals.
There are two things specifically tonight that I want to highlight for you. In the coming days, Public Works will be in contact with each of you to discuss sidewalks. Sidewalks have been a huge conversation. Public Works has identified sidewalk projects in each of the 35 Metro Council districts that we believe follow certain criteria – they connect to schools, they connect to transit lines and they fill in gaps in the sidewalk network where there is high pedestrian concentration. They will be asking for your insights as well so that work can begin as soon as possible.
We also are moving forward on updating the sidewalk and bikeway master plan. We have an innovative, high quality design process and a comprehensive public engagement process that we will use. This update will guide our city’s investments and strategies for pedestrians and cyclists.
This plan also has to involve all of you and a robust public input process to ensure that all voices and viewpoints are heard. I’ll provide more details as they come. We intend to build a lot of sidewalks and bike lanes over the next several years. So I want you to be assured that we are absolutely committed to that.
Second, we are moving forward with a conversation that was started last June regarding a new police administrative headquarters that will replace the one currently housed in the criminal justice center across from the courthouse.
We have worked with Councilmember Freddie O’Connell and Councilmember Colby Sledge and along with the Mayor’s office, we are going to host a community meeting to discuss the potential of building that headquarters on Murfreesboro Pike. It will be adjacent to the new Family Justice Center that we’re already building there.
The community meeting will be Wednesday, January 13th from 5:30 to 6:30 PM, at Trevecca Nazarene University.
This will be a great opportunity for you and the public to share your thoughts on this project. It is currently owned by Metro, so that makes it an easier site, but I want you all to be able to come and ask questions if you have questions.
I think you will hear a theme here: community engagement and input is critical to any decision-making process. Whether it is about where we are going to locate a new headquarters, whether it is about where we want new sidewalks – I want your input.
I want to thank you for your time. I want to thank you for what you do. I know that already you are very busy, because I have heard from several you about what is going on in your district.
I look forward to working with all of you over the next few months and years to come, so that we can build a better quality of life for all of our citizens. So thank you for inviting me here tonight, I do come at your invitation, so I appreciate that you welcomed me. Thank you so much, have a great evening.

Community Education Commission
Appointment of Ms. Matia Powell for a term expiring October 6, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Sexually Oriented Business Licensing Board
Reappointment of Ms. Tiffany Gray for a term expiring October 10, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Jonathan Richardson for a term expiring October 10, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Stormwater Management Committee

- BILLS ON PUBLIC HEARING –

SUBSTITUTE BILL NO. BL2015-25

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Hillsboro Village UDO to add text to the Building Façade standard, for all subdistricts, to reflect appropriate window and door opening orientation and alignment, and to add a definition of a mezzanine and a requirement that mezzanines are to be counted as an individual story (26.91 acres), all of which is described herein (Proposal No. 2005UD-009-004). Ms. Allen moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-30

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS15 to SP zoning for property located at 4190 Dodson Chapel Road, at the southwest corner of Dodson Chapel Road and Dodson Chapel Court (7.2 acres), to permit a daycare of up to 207 persons within an existing facility, all of which is described herein (Proposal No. 2014SP-006-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Rhoten requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling a Historic Bed & Breakfast Overlay District for property located at 3137 Long Boulevard, approximately 180 feet north of Mason Avenue (0.26 acres), zoned RM40 and located within the 31st Avenue and Long Boulevard Urban Design Overlay District, all of which is described herein (Proposal No. 2008Z-057-001). The bill was approved by the Planning Commission. Mr. Kindall requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2015-83

Douglas Avenue, Sherbourne Avenue, Waldkirch Avenue, and Wedgewood Avenue (approximately 151 acres), all of which is described herein (Proposal No. 2015NHC-002-001). The bill was approved by the Planning Commission. Mr. Sledge requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. A document was filed in opposition to the bill. The President declared the public hearing closed. Mr. Sledge moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-85

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of the Contextual Overlay District to various properties located along Pinewood Road, west of Stratford Avenue (approximately 8.0 acres), all of which is described herein (Proposal No. 2015Z-099PR-001). The bill was approved by the Planning Commission. Mr. Anthony Davis requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Davis moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-86

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 and R20 to SP for properties located at 326 Old Hickory Boulevard, Old Hickory Boulevard (unnumbered) and Highway 70 (unnumbered), on the east side of Old Hickory Boulevard and north of Highway 70 (approximately 246 acres), to permit the additional disturbance of the natural landscape to a maximum of 14 acres to permit up to 360 multi-family residential units, all of which is described herein (Proposal No. 2015SP-113-001).

BILL NO. BL2015-87

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling a portion of the Nashville Highlands Planned Unit Development Overlay District for properties located at 326 Old Hickory Boulevard, Old Hickory Boulevard (unnumbered) and Highway 70 (unnumbered), on the east side of Old Hickory Boulevard and north of Highway 70 (approximately 246 acres), zoned R15 and R20, all of which is described herein (Proposal No. 73-85P-001).

Ms. Mina Johnson moved to defer the bills to the February public hearing, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-88

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM9 to SP zoning for property located at 1419 Rosa L. Parks Boulevard, at the northwest corner of Taylor Street and Rosa L. Parks Boulevard (1.76 acres), to permit up to 100 multi-family residential units, all of which is described herein (Proposal No. 2016SP-003-001).

BILL NO. BL2015-89

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling a portion of the Cheatham Place Residential Planned Unit Development Overlay District for property located at 1419 Rosa L. Parks Boulevard, at the northwest corner of Rosa L. Parks Boulevard and Taylor Street (1.76 acres), zoned RM9, all of which is described herein (Proposal No. 2006P-001-002).

Mr. O’Connell requested a suspension of the rules to allow the bills to be heard and no objection was made. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-77

A resolution accepting a grant from The Conservancy for the Parthenon and Centennial Park to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for one employee’s salary. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-78

A resolution appropriating $30,000 through a grant contract between the Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, with Oasis Center, Inc. for the provision of youth services. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-79

A resolution accepting a grant from the Dorothy Cate and Thomas F. Frist Foundation to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission to benefit the How’s Nashville Project “Housing 2,016 by 2016”.
