The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Chris Harmon.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Agricultural Extension Board
Appointment of Mr. Bobby Edwards for a term expiring August 1, 2015. Mr. Edwards will fill the unexpired term of Mr. Thurman Rivers. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Will Nesby for a term expiring August 1, 2017. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historical Commission
Appointment of Mr. Alex Buchanan for a term expiring August 10, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-1218

A resolution approving a contract between the State of Tennessee, Department of Mental Health and Substance Abuse Services, and The Metropolitan Government of Nashville and Davidson County for establishing agreed rates for court ordered evaluations and treatment for defendants charged with misdemeanor crimes. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1219

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare eligible participants for re-entry into the labor force. The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees.

RESOLUTION NO. RS2014-1220

A resolution accepting the Centennial Park Master Plan Support Grant from The Conservancy for the Parthenon and Centennial Park to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to support the implementation of the Centennial Park Master Plan. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committee.

RESOLUTION NO. RS2014-1221

A resolution accepting a grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to provide twelve big band dances in Centennial Park. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-1222

A resolution approving Amendment One to a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide personal care services, homemaker services, and Nutrition HCBS (Home and Community Based Services) to eligible clients under the options program. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1223

A resolution approving a cooperative agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Centerstone of Tennessee to provide a Worksite POD for licensed medical employees and other licensed medical professionals specified by Centerstone of Tennessee with mass prophylaxis for distribution in the event of a public health emergency. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2014-1224

A resolution approving a clinical experience agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the University of Tennessee to provide clinical experience opportunities to enrolled students. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2014-1225

A resolution authorizing A. Marshal Family Foods, Inc. dba Puckett’s, Inc. to install, construct and maintain an aerial encroachment at 500 Church Street for Puckett’s Grocery Store (Proposal No. 2014M-010EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1226

A resolution authorizing Goo Goo Cluster, LLC to construct and install an aerial encroachment at 116 3rd Avenue South (Proposal No. 2014M-012EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1227

A resolution authorizing Boot Barn, Inc. to construct and install an aerial encroachment at 318 Broadway (Proposal No. 2014M-013EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1228

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Robert Crocker in the amount of $49,010.75, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1229

A resolution recognizing September as National Childhood Obesity Awareness Month. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1230

A resolution proclaiming October 9, 2014, as PANDAS Awareness Day. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

An ordinance to approve an affiliation agreement by and between Vanderbilt University and The Metropolitan Government of Nashville and Davidson County to provide student clinical instruction and training with Davidson County Community Corrections. BILL NO. BL2014-895

An ordinance declaring surplus and approving the disposition of certain parcels of real property labeled Exhibits A-T and described below (Proposal No. 2014M-021PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-670

An ordinance authorizing the acquisition of certain right-of-way, permanent easements, and temporary construction easements and property rights by negotiation or condemnation for use in public projects of the Metropolitan Government, initially for purposes of Public Works Department Project Number 2013-B-3, Gulch Pedestrian Bridge (Proposal No. 2013M-045PR-001). The bill was approved by Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees. Pursuant to Rule No. 23, the bill was deferred.

BILL NO. BL2014-835

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to SP zoning for property located at 1813 Beech Avenue, approximately 390 feet north of Wedgewood Avenue (0.49 acres), to permit up to seven detached residential units, all of which is described herein (Proposal No. 2014SP-033-001). The bill was approved by the Planning Commission with conditions, disapproved without. The bill was approved by the Planning, Zoning and Historical Committee. Ms. Moore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-860

An ordinance amending Section 13.08.015 of the Metropolitan Code pertaining to the naming of streets, and amending the Geographic Information Systems Street and Alley Centerline Layer for The Metropolitan Government of Nashville and Davidson County by renaming a portion of 28th Avenue North and 31st Avenue North as “Ed Temple Boulevard” (Proposal No. 2014M-004SR-001). The bill was approved by the Emergency Communications District Board and referred to the Planning Commission. The Public Works, Traffic, Parking and Transportation and Planning, Zoning and Historical Committees recommended deferment. Mr. Maynard moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-871

An ordinance adopting property identification maps for The Metropolitan Government of Nashville and Davidson County, which shall be the official maps for the identification of real estate for tax assessment purposes. The bill was approved by the Planning, Zoning and Historical Committee. Mr. Hunt moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-872

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, hereinafter known as “METRO”, to participate with LPC Contractors of Southeast, Inc. hereinafter known as “LINCOLN”, to provide public water service improvements for both LINCOLN’s proposed development, as well as other existing properties in the area (Project No. 14-WL-0050). The bill was approved by the Budget and Finance and Public Works Committees. Ms. Langster moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-873

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services herein after known as “METRO”, to participate with Laurel Property, LLC hereinafter known as “LAUREL”, to provide public water service improvements for both LAUREL’s proposed development, as well as other existing properties in the area (Project No. 14-WL-0052). The bill was approved by the Budget and Finance Committee; the Public Works Committee recommended deferment. Mr. Pridemore moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-874

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing 10 foot Public Utility Drainage Easement (“P.U.D.E.”) that was previously recorded in Plat Book 1835, Page 10 and in Plat Book 3106, Page 105 for properties located at 3622, 3622B, 3624, 3630, 3630B, and 3632 Redmon Street and at Normandy Circle (unnumbered), (Proposal No. 2014M-040ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Anthony Davis moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon retained easement rights in a portion of former Alley #1999 (to be abandoned by the Metro Council) for the property located at 1001 Riverside Drive (Proposal No. 2014M-043ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Westerholm moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-876

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon retained easement rights, not to include those retained by NES, in a portion of the former right-of-way of Alley #63 (closed via Council Ordinance BL2014-672) for a portion of the properties located at 700 Broadway and 126 Rosa L. Parks Boulevard (Proposal No. 2014M-039ES-001).
The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon retained easement rights in a portion of the former right-of-way of Alley #123 (closed via Council Ordinance O76-196) for properties located at 300 and 312 9th Avenue South (Proposal No. 2014M-027ES-002). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by closing and abandoning portions of the right-of-way and easements for Alleys Nos. 115 and 123, and to authorize the execution of a quitclaim deed to convey any interest the Metropolitan Government possesses in right-of-way that would not already be extinguished by the aforementioned abandonment (Proposal No. 2014M-012AB-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.
