Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Tony Tenpenny.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Board of Equalization
Appointment of Ms. Jackie Daniel for a term expiring April 1, 2016. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Jean Harrison for a term expiring April 1, 2016. At the request of the nominee, the confirmation was deferred.

Reappointment of Mr. Marshall Karr for a term expiring April 1, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Bob Noestine for a term expiring April 1, 2016. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Derrick Starks for a term expiring April 1, 2016. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fair Board
Appointment of Mr. Caleb Hemmer for a term expiring April 6, 2019. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fire and Building Code Appeals Board
Appointment of Ms. Katherine Gathings for a term expiring March 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education, Community and Arts Television Corporation (NECAT)
Appointment of Ms. Cary Foust Street for a term expiring February 5, 2017. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Reappointment of Mr. Greg Adkins for a term expiring March 31, 2018. At the request of the nominee, the confirmation was deferred.

Plumbing Examiners and Appeals Board
Appointment of Mr. David Adcox, Jr. for a term expiring March 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Paul McCown for a term expiring February 15, 2015. Mr. McCown will fill the unexpired term of Mr. Ron Holdaway. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Sports Authority
Appointment of Mr. Marcus A. Currie for a term expiring February 17, 2016. Mr. Currie will fill the unexpired term of Mr. Alfonzo Alexander. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Robert Obrohta for a term expiring February 19, 2020. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-1049

A resolution authorizing the Metropolitan Mayor to submit an Annual Update to the 2013-2018 Consolidated Plan for Housing and Community Development to the U.S. Department of Housing and Urban Development. The resolution was approved by the Budget and Finance and Federal Grants Review Committees.

RESOLUTION NO. RS2014-1050

A resolution authorizing the transition to an Alternative Site Framework for Foreign Trade Zone #78. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1053

A resolution accepting a Tennessee Historical Commission Certified Local Government (CLG) Training Grant from the Tennessee Historical Commission to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Historical Commission, to provide continuing education for staff at the National Alliance of Preservation Commissions’ biannual forum. The resolution was approved by the Budget and Finance and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1054

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for the provision of Breast and Cervical Cancer Early Detection Program Services. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1055

A resolution approving Amendment One to a grant from the U. S. Department of Health and Human Services to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to create a comprehensive strategy to address issues and barriers to responsible fatherhood. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1056

A resolution accepting an incentive grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to use incentive funds for various planned activities that increase the employment, retention, and earnings of participants (LW09P121NCNTV13). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees.

RESOLUTION NO. RS2014-1057

A resolution accepting a grant from the State of Tennessee, Department of Children’s Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, for ongoing professional training for Juvenile Court Probation Officers. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1058

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Samuel Carter against the Metropolitan Government of Nashville and Davidson County in the amount of $6,500.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1059

A resolution authorizing the Metropolitan Department of Law to compromise and settle the property damage claim of Novacopy, Inc. against the Metropolitan Government of Nashville and Davidson County in the amount of $18,702.94, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1060

A resolution setting the date and time for the State of the Metropolitan Government Address. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1062

A resolution supporting the efforts of the Tennessee General Assembly to honor our fallen heroes and their families by naming State Route 1 “The Gold Star Families Memorial Highway”. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1063

A resolution recognizing May 1, 2014, as National Day of Prayer. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1052

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The Charter Revision Committee recommended deferment to the second meeting in May. Ms. Allen moved to defer the resolution to the second meeting in May, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2014-1061

A resolution declaring May 1, 2014, as Ann Teaff Day in the City of Nashville. The resolution was approved by the Rules-Confirmations-Public Elections Committee. An ordinance amending Section 7.08.090 of the Metropolitan Code to exempt beer permit applicants from the minimum distance requirements from residential property if the applicant’s primary residence is connected to the establishment for which a permit is sought. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2014-743

An ordinance amending Section 7.08.100 of the Metropolitan Code to reduce the minimum seating capacity for eating establishments to obtain a retailer on-sale beer permit. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2014-744

An ordinance approving the form of a license agreement to use Metropolitan Government property for Network Huts by Google Fiber company (Proposal No. 2014M-010PR-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-745

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning right-of-way and easements for an unnumbered alley from Lea Avenue to Alley No. 102, between Hermitage Avenue and Rutledge Avenue (Proposal No. 2013M-016AB-001). The bill was approved by the Planning Commission and Traffic and Parking Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-746

An ordinance declaring surplus and approving the disposition of certain parcels of real property labeled Exhibits A-G and described below (Proposal No. 2014M-011PR-001). The bill was approved by the Planning Commission. An ordinance amending Chapters 17.04, 17.08 and 17.16 of the Metropolitan Code to add a definition and conditions of “Communications Hut.” (Proposal No. 2014Z-013TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-697

An ordinance amending Section 7.08.090 of the Metropolitan Code to exempt existing on-premises beer permit holders from the distance requirements regarding the sale of beer near school property when a new school locates within 100 feet of the existing establishment. The bill was approved by the Public Safety-Beer and Regulated Beverages Committee with an amendment. Ms. Blalock offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Ms. Blalock moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-726

An ordinance granting the Purchasing Agent and the Metropolitan Employee Benefit Board the authority to extend the current medical plan contracts for up to an additional two years. The bill was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees. Mr. Steine moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-727

An ordinance to amend provisions of Metropolitan Code §2.140 to include the Metro Archivist as a member of the Public Records Commission. The bill was approved by the Personnel-Public Information-Human Resources-Housing and Rules-Confirmations-Public Elections Committees. Mr. Westerholm moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-728

An ordinance amending Section 5.12.140 B of the Metropolitan Code to extend the expiration date for the assessment, collection and administration of the additional hotel occupancy privilege tax of fifty cents. The bill was approved by the Budget and Finance and Convention, Tourism and Public Entertainment Facilities Committees. Mr. Steine moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-729

An ordinance approving a Lease Agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of General Services, and KIPP Nashville (Proposal No. 2014M-006PR-001). The bill was approved by the Planning Commission, Budget and Finance, Education and Planning, Zoning and Historical Committees. Mr. Scott Davis moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing the Director of Public Property to accept and record an easement in favor of the Metropolitan Government on a parcel of property for use in the Whites Creek Greenway system (Proposal No. 2014M-009ES-001). The bill was approved by the Planning Commission, Budget and Finance, Parks, Library and Recreation and Planning, Zoning and Historical Committees. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Nashboro Village Planned Unit Development Overlay District for a portion of property located at Nashboro Boulevard (unnumbered), at the southwest corner of Nashboro Boulevard and Flintlock Court, zoned R10 (3.46 acres), to permit neighborhood retail uses not to exceed one story, where 27,600 square feet of commercial uses was previously approved, all of which is described herein (Proposal No. 74-79P-009). Ms. Johnson offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2012-302

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Nashboro Village Planned Unit Development Overlay District for a portion of property located at Nashboro Boulevard (unnumbered), at the southwest corner of Nashboro Boulevard and Flintlock Court, zoned R10 (3.46 acres), to permit neighborhood retail uses not to exceed one story, where 23,375 square feet of commercial uses was previously approved, all of which is described herein (Proposal No. 74-79P-009).
