Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Nashville Youth Poet Laureate Cassidy Martin.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of December 6, 2016 were approved.

- ELECTIONS AND CONFIRMATIONS -

Stormwater Management Committee
Reappointment of Mr. G. Dodd Galbreath for a term expiring October 31, 2020. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- PROPOSED RULES AMENDMENTS -

Mr. Shulman reported that proposed amendments to the Rules of Procedure of the Metropolitan Council were approved by the Rules, Confirmation, and Public Elections Committee. Those items will be distributed to the Council for a vote at the next meeting on January 3, 2017.

- RESOLUTIONS ON PUBLIC HEARING-

RESOLUTION NO. RS2016-487

A resolution exempting Barcelona Edgehill, LLC/Barcelona Wine Bar located at 1200 Villa Place, Suite 110, from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. Sledge requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-491

A resolution accepting a grant from the Tennessee Titans Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Sports Authority, to assist with new purchases benefiting the Special Event Program funded by the Public Investment Plan. The resolution was approved by the Budget and Finance and Convention, Tourism, Public Entertainment Facilities Committees.

RESOLUTION NO. RS2016-492

A resolution accepting a T.O.T.A.L. (Totally Outstanding Teen Advocates for the Library) Grant from the Nashville Public Library Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Library, to provide a leadership team to design, develop, and implement programs for both the public and other teens at a minimum of five branch locations. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-493

A resolution accepting a grant from the Tennessee State Library and Archives to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to provide a well-trained library staff to assist customers in accessing technology as a means of closing the digital divide. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-494

A resolution accepting a grant from Red Caboose Playground, Inc. to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, for the benefit of Red Caboose Playground in Bellevue Park. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-495

A resolution approving Amendment One to an Emergency Solutions Grant from the State of Tennessee, Tennessee Housing Development Agency, to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission to provide services to the homeless and those at risk from homelessness. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-497

A resolution approving Amendment Four to a grant from the U.S. Department of Health and Human Services to the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to enhance access to a comprehensive continuum of high quality, community-based care for low income individuals and families with HIV disease. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-498

A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the Progreso Community Center to operate a mobile unit to provide services to current and potential Women Infants & Children (WIC) Program recipients. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-499

A resolution approving an application for a Federal Lands Access Program (FLAP) Grant from the U.S. Department of Transportation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Planning Department, to improve state and local transportation facilities that provide access to and through federal lands for visitors, recreationists, and resource users. The resolution was approved by the Budget and Finance and Planning, Zoning, and Historical Committees.

RESOLUTION NO. RS2016-500

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claims of Rebecca Jamison and Oran Jamison against the Metropolitan Government of Nashville and Davidson County in the amount of $75,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-501

A resolution recognizing and celebrating Joseph “Joe Pat” Patrick Breen’s 55th anniversary of the priesthood. The resolution was approved by the Rules, Confirmation, and Public Elections Committee.

RESOLUTION NO. RS2016-502

A resolution recognizing the Nashville Junior Chamber and Hytch, LLC. The resolution was approved by the Rules, Confirmation, and Public Elections Committee.

A resolution requesting the Metropolitan Board of Public Education to require all buses purchased for purposes of serving Metropolitan Nashville Public School students to be equipped with seatbelts. The resolution was approved by the Education Committee with an amendment. Ms. Johnson offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL to MUN-A zoning on property located at 2214 Gains Street, at the southeast corner of Free Silver Road and Gains Street, (0.12 acres), all of which is described herein (Proposal No. 2016Z-121PR-001). The bill was approved by the Planning Commission. BILL NO. BL2016-538

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a Preliminary SP on properties located at 1267 and 1271 3rd Avenue South, at the southwest corner of 3rd Avenue South and Hart Street, zoned SP (0.95 acres), to permit a mixed-use development with up to 89 residential units and a maximum 8,500 square feet of non-residential uses, all of which is described herein (Proposal No. 2016SP-039-002). The bill was approved by the Planning Commission with conditions, disapproved without. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-539

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a contextual overlay on various properties located along Colbert Drive and Shadow Lane, east of Rosebank Avenue, (16.21 acres), all of which is described herein (Proposal No. 2016Z-138PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

Without objection, the rules were suspended for consideration of one (1) late ordinance.

BILL NO. BL2016-540

An ordinance repealing, in part, Ordinance No. BL2014-688, as amended, to rescind the Metropolitan Council’s approval of the Agreement to Lease and Purchase between Metropolitan Government of Nashville and Davidson County, Autumn Assisted Living Partners, Inc., and the Hospital Authority of the Metropolitan Government of Nashville and Davidson County, dated January 10, 2014, regarding the disposition of real property relating to The Knowles Home Assisted Living and Adult Day Services facility; and further repealing Ordinance No. BL2015-1283, as amended, to rescind the Metropolitan Council’s approval of the Purchase and Sale Agreement by and between Vision Real Estate Investment Corporation and the Metropolitan Government of Nashville and Davidson County for the sale of approximately 76 acres located at 1010 Camilla Caldwell Lane. Mr. Leonardo moved to pass the bill on first reading and refer the bill to the Budget and Finance and Health, Hospitals, and Social Services Committees which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-494

An ordinance establishing a program for the purpose of providing assistance to low-income elderly residents of the Metropolitan Government for the fiscal year 2016-2017. The bill was approved by the Budget and Finance Committee. Mr. Cooper moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-495

An ordinance amending Title 2 of the Metropolitan Code of Laws relative to Economic and Community Development Incentive Grants. The Budget and Finance Committee made no recommendation. Mr. Cooper moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-496

An ordinance amending Section 12.40.040 of the Metropolitan Code to prohibit non-electric vehicles from parking in electric vehicle charging stations. The Public Works and Traffic, Parking, and Transportation Committees recommended deferment. Mr. Bedne moved to defer the bill, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-497

An ordinance amending Section 12.40.090 of the Metropolitan Code to provide guidance for placement of handicapped parking spaces on public streets outside residential properties. The Public Works and Traffic, Parking, and Transportation Committees recommended deferment. Mr. Sledge moved to defer the bill to the second meeting in January, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-498

An ordinance to amend Chapter 13.20 of the Metropolitan Code to require approval by the Metropolitan Council for obstructions or excavations which close or occupy any portion of the public right of way for a period in excess of one (1) year. The Public Works Committee recommended deferment. Mr. Elrod moved to defer the bill to the second meeting in January, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-499

An ordinance authorizing the granting of temporary and permanent easements to Piedmont Natural Gas Co. on certain property owned by the Metropolitan Government (Tax Map 094-00-0 Parcels 029.00, 038.00 and 039.00 and Tax Map 094-10-0 Parcel 059.00) (Proposal No. 2016M-052ES-001). The bill was approved by the Planning Commission, Budget and Finance, Planning, Zoning, and Historical, and Public Works Committees. Mr. O’Connell moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.
