The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.
The invocation was offered by Minister Tyrone Carter of Mt. Zion Baptist Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of October 21, 2014, were approved.
- PROPOSED RULES AMENDMENT -
The following proposed amendment to the Rules of Procedure of the Metropolitan Council was distributed and will be considered at the next regular meeting of Council:
23. Deferrals; excessive deferrals; indefinite deferrals
Rule 23 of the 2011-2015 Rules of Procedure of the Council, as amended, be further amended by deleting the third paragraph in its entirety and substituting with the following:
“Any ordinance or resolution that has been deferred indefinitely for a period of more than ninety (90) days shall automatically be deferred for one meeting upon being placed back on the agenda at the request of the sponsor pursuant to this rule and shall be re-referred to the appropriate committee(s) selected by the Vice Mayor for a recommendation.”
- ELECTIONS AND CONFIRMATIONS -
Health and Educational Facilities Board
The President announced that an election would be held to fill two vacancies on the Health and Educational Facilities Board. The nominees were: Richard L. Brown and Robert Perry. Mr. Harmon reported that the Rules-Confirmations-Public Elections Committee had considered and found both candidates to be qualified to serve. Mr. Harmon moved that Mr. Brown and Mr. Perry be elected by acclamation, which motion was seconded and adopted by a voice vote of the Council for a term expiring September 30, 2020.
Human Relations Commission
Appointment of Ms. Aisha Lbhalla for a term expiring April 18, 2016. Ms. Lbhalla will fill the unexpired term of Mr. Jonathan Giles. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Social Services Commission
Appointment of Ms. Kim Johnson for a term expiring July 20, 2019. Ms. Johnson will fill the unexpired term of Ms. Nikita Jones. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Wastewater Hearing Authority
Reappointment of Ms. Ruthie Brown Cherry for a term expiring October 1, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
- BILLS ON PUBLIC HEARING -
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning for various properties located along Arrington Street, Berry Street, Cleveland Street, Douglas Avenue, Evanston Avenue, Joseph Street, Lischey Avenue, Meridian Street, Montgomery Avenue, N. 2nd Street, N. 5th Street, N. 6th Street, N. 7th Street, N. 8th Street, Pennock Avenue, Richardson Avenue, Stainback Avenue, Stockell Street, Treutland Avenue, Vaughn Street and Vernon Winfrey Avenue, south of Douglas Avenue (238.26 acres), to allow detached accessory dwelling units with all other standards of the RS5 district being applicable, all of which is described herein (Proposal No. 2014SP-076-001). The bill was approved by the Planning Commission with conditions, disapproved without.
Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Davis moved to pass the bill on second reading, which motion was seconded. After discussion, Mr. Hunt called for the previous question, which motion was seconded and adopted by a voice vote of the Council. The matter recurred on the motion to pass and was adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to RS10 zoning for various properties located along Auburn Lane, Dartmouth Avenue, Tulane Court and Woodmont Lane, south of Woodmont Boulevard (approximately 23.87 acres), all of which is described herein (Proposal No. 2014Z-054PR-001). The bill was approved by the Planning Commission. Mr. McGuire requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. McGuire moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CF to SP zoning for properties located at 1707 Broadway and at 109, 115, 119 and 121 17th Avenue South, at the southwest corner of Broadway and 17th Avenue South (1.47 Acres), to permit a mixed use building of up to 25 stories in height, all of which is described herein (Proposal No. 2014SP-066-001). The bill was approved by the Planning Commission with conditions, disapproved without.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling a portion of the Music Row Urban Design Overlay District for properties located at 1707 Broadway and at 109, 115, 119 and 121 17th Avenue South, at the southwest corner of 17th Avenue South and Broadway, zoned CF (1.36 acres), all of which is described herein (Proposal No. 2001UD-002-009). The bill was approved by the Planning Commission.

The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Weiner requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL to CS zoning for a portion of property located at 2706 Old Lebanon Pike, at the southeast corner of Old Lebanon Pike and Toddway Court and located within the Downtown Donelson Urban Design Overlay District (0.49 acres), all of which is described herein (Proposal No. 2014Z-052PR-001). The bill was approved by the Planning Commission. Mr. Claiborne moved to defer the bill to the December public hearing, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Nolensville Pike Car Wash Specific Plan District for property located at 5828 Nolensville Pike, approximately 1,400 feet south of Old Hickory Boulevard and partially located within the Floodplain Overlay District (1.08 acres), to permit CS sign standards and an LED sign, all of which is described herein (Proposal No. 2011SP-012-003). The bill was disapproved by the Planning Commission. Ms. Blalock requested a hearing from the public on this bill which had been previously advertised. The bill was approved by the Planning Commission with an amendment. Ms. Dowell requested a hearing from the public on this bill which had been previously advertised. The bill was disapproved by the Planning Commission as submitted, approved with substitute. Ms. Allen requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare eligible participants for re-entry into the labor force (LW09F141ABSWA14). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees.

A resolution accepting a grant from the State of Tennessee, Administrative Office of the Courts, to The Metropolitan Government of Nashville and Davidson County for the provision of interpreter services for defendants with limited English proficiency who have been found to be indigent or have a statutory or constitutional right to appointed council. The resolution was approved by the Budget and Finance Committee.
A resolution approving an intergovernmental agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, and Tennessee Valley Authority for extra-duty police services. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.
A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase real property for use in a public project for the Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of facilities for the Nashville Police Department in the Murfreesboro Road area (Proposal No. 2014M-025PR-001).
The resolution was approved by the Budget and Finance, Public Safety-Beer and Regulated Beverages and Planning, Zoning and Historical Committees.
A resolution accepting a grant from the Tennessee Historical Commission to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Historical Commission, to conduct research and photography of two eligible districts for the National Register of Historic Places – Inglewood Place and Bluefields. The resolution was approved by the Budget and Finance and Planning, Zoning and Historical Committees.
A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide nutrition education and services to eligible women, infants, and children (WIC) and breast feeding peer counseling programs for citizens of Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.
A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for the provision of immunization program activities and staffing to monitor and assess the delivery of immunization services by providers in Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Ian Mauldin against The Metropolitan Government of Nashville and Davidson County in the amount of $15,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Craig Redferrin against the Metropolitan Government of Nashville and Davidson County in the amount of $12,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.
A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.
A resolution electing two members to the Board of Directors of The Health and Educational Facilities Board of The Metropolitan Government of Nashville and Davidson County, Tennessee. The resolution was approved by the Rules-Confirmations-Public Elections Committee.
A resolution authorizing Chauhan, LLC, dba Chauhan Ale and Masala, to construct and install an aerial encroachment at 123 12th Avenue North (Proposal No. 2014M-017EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

- RESOLUTIONS -
A resolution extending the term of the Study and Formulating Committee. The resolution was approved by the Personnel-Public Information-Human Resources-Housing Committee. Ms. Weiner moved to adopt the resolution, which motion was seconded. Mr. Garrett moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.
A resolution amending the pay plan for the general employees of The Metropolitan Government of Nashville and Davidson County approved under Resolution RS2014-1127, by changing the salaries for the positions of Mayor, Vice Mayor, and members of the Metropolitan County Council. The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees. A resolution accepting a grant from the Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Emergency Management, to fund costs related to homeland security preparedness activities associated with implementing the Tennessee State Homeland Security Strategies and National Preparedness Goals. The Budget and Finance and Public Safety-Beer and Regulated Beverages Committees recommended withdrawal. Mr. Pridemore moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.
RESOLUTION NO. RS2014-1252
A resolution requesting President Barack Obama and the United States Congress to select public infrastructure improvements as the priority activity of the United States to upgrade the current substandard infrastructure of the nation, strengthen the national economy, and support healthy and vibrant communities in the United States. Mr. Stanley offered a substitute resolution and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.
SUBSTITUTE RESOLUTION NO. RS2014-1252

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to regulate the commercial use of pedicab and pedal carriages within certain portions of Nashville and Davidson County, and to amend Title 6 of the Metropolitan Code to provide for such regulations. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Convention, Tourism and Public Entertainment Facilities, Public Works and Traffic, Parking and Transportation Committees by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County (“Metro”), acting by and through the Metropolitan Department of Water and Sewerage Services (“Metro Water Services”), to subsidize the cost of rain barrels for the residents of the Metropolitan Government of Nashville and Davidson County. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.
An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County, by naming the private road accessing the Harpeth Trace Condominiums “Harpeth Trace Summit” from Harpeth Trace Drive eastwardly to its terminus (Proposal No. 2014M-002SR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Emergency Communications District Board, Public Works, Traffic, Parking and Transportation and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Bell Road Stormwater Improvement Project for two properties located at 550 and 554 Bell Road (MWS Project No. 15-SWC-024 and Proposal No. 2014M-061ES-001).The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Tuckahoe Drive Stormwater Improvement Project for four properties located at 602, 603, and 605 Tuckahoe Drive and 114 Rhine Drive (Project No. 15-SWC-030 and Proposal No. 2014M-056ES-001. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
