Metropolitan Council Meeting
Tuesday, April 12, 2011


The Metropolitan Council met in special session on this date at 6:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Sean McGuire.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Garrett, Barry, Tygard, Steine, Maynard, Matthews, Harrison, Hunt, Craddock, Hollin, Jameson, Cole, Forkum, Ryman, Jernigan, Gotto, Stanley, Claiborne, Page, Moore, LaLonde, Gilmore, Baker, Langster, Crafton, Evans, Holleman, McGuire, Adkins, Foster, Dominy, Wilhoite, Hodge, Toler, Coleman, Duvall, Todd, Mitchell and Neighbors (39); Absent: Bennett, Burch (2).

The Minutes of the regular meeting of April 5, 2011, and the adjourned meeting of April 7, 2011, were approved.

Re: Special Council Meeting

Dear Members of the Metropolitan Council,

Pursuant to Section 3.04 of the Metropolitan Charter, I am calling a Special Meeting of the Council to be held Tuesday, April 12, 2011, at 6:00 p.m. for the purpose of considering the following legislation:

Ordinance No. BL2011-867 An ordinance approving a construction agreement with CSX Transportation, Inc.

Ordinance No. BL2011-868 An ordinance abandoning 190 feet of an 8 inch sanitary sewer line and a 20 foot public utility easement for Centennial Medical Office properties, located at 2216 and 2222 Murphy Road and 334 23rd Avenue North.

Ordinance No. BL2011-873 An ordinance abandoning a 10 inch sanitary sewer line and easement, Project 11-SL-0004, Bristol Germantown, Alley Numbers 221 and 205.

Ordinance No. BL2011-902 An ordinance approving and adopting a plan for redistricting the Councilmanic Districts of The Metropolitan Government of Nashville and Davidson County and revising the school districts pursuant to Article 18, Section 18.06 of the Metropolitan Charter.

Resolution No. RS2011-1607 A resolution opposing any state legislation that would change the Metropolitan Mayor, Vice Mayor, and/or Council terms of office to coincide with November partisan elections.

An ordinance approving a construction agreement with CSX Transportation, Inc. The bill was approved by the Budget and Finance and Public Works Committees. Ms. Barry moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: “Ayes” Garrett, Barry, Tygard, Steine, Maynard, Matthews, Harrison, Hunt, Craddock, Hollin, Jameson, Cole, Forkum, Ryman, Jernigan, Gotto, Stanley, Claiborne, Page, Moore, LaLonde, Gilmore, Baker, Langster, Crafton, Evans, Holleman, McGuire, Adkins, Foster, Dominy, Wilhoite, Hodge, Toler, Coleman, Duvall, Todd, Mitchell (38); “Noes” (0).

BILL NO. BL2011-868

An ordinance abandoning 190 feet of an 8 inch sanitary sewer line and a 20 foot public utility easement for Centennial Medical Office properties, located at 2216 and 2222 Murphy Road and 334 23rd Avenue North, in connection to Project 10-SL-176, shown on Map 92-11, Parcel 213, 217, 218, and 227, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2010M-028ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Hodge moved to suspend the rules to allow an amendment and no objection was made. Mr. Hodge offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. The bill was approved by the Planning Commission and the Planning, Zoning and Historical Committee. RESOLUTION NO. RS2011-1607

A resolution opposing any state legislation that would change the Metropolitan Mayor, Vice Mayor, and/or Council terms of office to coincide with November partisan elections. The resolution was approved by the Rules-Confirmations-Public Elections. Mr. Maynard moved to defer the bill by rule, which motion was seconded and adopted by a voice vote of the Council.

Upon motion duly seconded, the meeting was adjourned.
