Metropolitan Council Meeting
Tuesday, June 11, 2002


The Metropolitan Council met in adjourned session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Ronnie Greer.

The Metropolitan Council gave the pledge of allegiance to the American Flag.
The roll was called and the following members were present during the progress of the meeting: Ferrell, Briley, Tucker, Black, Majors, Hall, Beehan, Campbell, Hart, Dillard, Balthrop, Ponder, Derryberry, Stanley, McClendon, Greer, Hausser, Wallace, Haddox, Whitmore, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Kerstetter, Jenkins, Turner, Williams, Lineweaver, and President Pro Tem Gentry (32); Absent: Waters, Gilmore, Nollner, Brown, Loring, Hand, Holloway, Knoch (8).

The Minutes of the regular meeting of June 4, 2002 were approved.

BILL NO. BL2002-1047

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by changing the name of Lincoln Street to "Day Street" between Old Buena Vista Pike and West Trinity Lane (Proposal No. 2002M-022U-03). The bill was approved by the Planning Commission, ECD Board, Public Works, Traffic and Parking and Planning, Zoning and Historical Committees. Mr. Black moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: "Ayes" Ferrell, Briley, Tucker, Black, Majors, Hall, Beehan, Campbell, Hart, Dillard, Balthrop, Ponder, Derryberry, Stanley, McClendon, Greer, Hausser, Wallace, Haddox, Whitmore, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Kerstetter, Jenkins, Turner, Williams, Lineweaver (31); "Noes" (0).

BILL NO. BL2002-1062

An ordinance adopting the Capital Improvements Budget and Program 2002-2003 through 2007-2008 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2002-2003. The bill was approved by the Planning Commission and by the Budget and Finance and Planning, Zoning and Historical Committees with fourteen amendments.

Mr. Shulman moved to pass the bill on third reading with fourteen amendments and for the adoption of the amendments in a single vote, which motion was seconded. Mr. Summers objected to a single vote on all fourteen amendments and requested a division of the question so that Amendment No. 7 could be voted on individually. Mr. Dillard called for the previous question, which motion was seconded and failed by a vote of the Council. After further discussion, Mr. Briley called for the previous question, which motion was seconded and adopted by a voice vote of the Council. The vote was called for approval of Amendment No. 7, which motion was adopted by the following vote: "Ayes" Ferrell, Tucker, Black, Majors, Beehan, Dillard, Derryberry, Hausser, Wallace, Haddox, Whitmore, Bogen, Shulman, Sontany, Turner, Williams, Lineweaver (17) "Noes" Campbell, Hart, Ponder, Stanley, McClendon, Summers, Arriola, Alexander, Kerstetter, Jenkins, (10); "Abstaining" Briley, Hall, Balthrop, Greer (4).

Ms. Arriola objected to a single vote on the remaining thirteen amendments and requested a division of the question so that Amendment No. 3 could be voted on individually. The vote was called for approval of Amendment No. 3, which amendment was adopted by the following vote: "Ayes" Ferrell, Briley, Tucker, Black, Majors, Hall, Beehan, Hart, Dillard, Balthrop, Ponder, Derryberry, Stanley, McClendon, Greer, Wallace, Haddox, Whitmore, Bogen, Summers, Shulman, Sontany, Alexander, Kerstetter, Jenkins, Turner, Williams, (27); "Noes" Campbell, Arriola, Lineweaver (3); "Abstaining" Hausser (1).

Mr. Shulman moved that the remaining twelve amendments be approved, which motion was seconded and adopted by a voice vote of the Council Mr. Shulman renewed his motion to pass the bill on third reading with fourteen amendments. After discussion, Mr. Briley called for the previous question, which motion was seconded and adopted by a voice vote of the Council. BILL NO. BL2002-1065

An ordinance approving a grant from the U.S. Department of Treasury, Bureau of Alcohol, Tobacco and Firearms to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Police Department for the Gang Resistance Education and Training program (G.R.E.A.T.). The bill was approved by the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees. An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring utility easements for use in public projects of the Metropolitan Government and specifically with relation to Project No. 99-SG-169 and 99-WG-158, I-40 & Robertson Avenue/Briley Parkway proposed water and sewer interchange improvements (Proposal No. 2002M-033U-07). The bill was approved by the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees. An ordinance amending Title 12 of the Metropolitan Code of Laws by changing the definition of "abandoned motor vehicle" in Section 12.08.210. The bill was approved by the Codes, Fair and Farmers Market Committee. Mr. Majors moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2002-1072

An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Book Publishing Company, including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before February 5, 2002. The bill was approved by the Rules-Confirmations-Public Elections Committee.
