RESOLUTION NO. RS2017-580

A resolution to amend Ordinance No. BL2016-103 to abandon existing sewer mains and easements and to accept new sewer mains, manholes and any associated easements for four properties located along Franklin Pike (MWS Project No. 15-SL-207 and Proposal No. 2017M-016ES-001).

WHEREAS, Ordinance No. BL2016-103, approved February 5, 2016, authorized the abandonment of approximately 80 linear feet of existing 10 inch sewer main and 537 linear feet of existing 36 inch sewer main and the acceptance of approximately 80 linear feet of new 10 inch sewer main and 537 linear feet of new 36 inch sewer main and easements, along with six new manhole assemblies, for properties located at 2600, 2608, 2610, and 2612 Franklin Pike; and,

WHEREAS, Ordinance No. BL2016-103 now needs to be amended to abandon approximately 65 linear feet of existing 10 inch sanitary sewer main, 294 linear feet of existing 36 inch sanitary sewer main and easements, and to accept approximately 94 linear feet of new 10 inch sewer main, 457 linear feet of new 36 inch sanitary sewer main, six sanitary manholes and any associated easements for properties located at 2600, 2608, 2610, and 2612 Franklin Pike, to construct project number 15-SL-207; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-016ES-001 on February 6, 2017, for the abandonment and acceptance of said sewer mains, manholes and easements.

WHEREAS, Ordinance No. BL2016-103 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2016-103 is hereby amended to abandon approximately 65 linear feet of existing 10 inch sanitary sewer main, 294 linear feet of existing 36 inch sanitary sewer main and easements, and to accept approximately 94 linear feet of new 10 inch sewer main, 457 linear feet of new 36 inch sanitary sewer main, six sanitary manholes and any associated easements for properties located at 2600, 2608, 2610, and 2612 Franklin Pike as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
