RESOLUTION NO. RS2010-1229

A resolution amending the pay plan for the employees of the Metropolitan Departments of Fire and Police, approved under Resolution No. RS2005-873, and as subsequently amended, by delaying increment advances for one year beginning July 1, 2010, by replacing increments with a one time only two (2%) percent of salary lump sum payroll adjustment, capped at $2,000, and by adopting a minimum hourly rate for full time employees.

WHEREAS, a pay plan was adopted for employees of the Metropolitan Departments of Fire and Police, by passage of Resolution No. RS2005-873; and,

WHEREAS, the pay plan assigns all employment classifications to a salary grade, with such assignments being equitably related to each other; and,

WHEREAS, the pay plan allows for increment increases for the employment classifications in varying six months, one year, eighteen months, and two year intervals; and,

WHEREAS, due to the economy, the Metropolitan Government experienced a revenue shortfall for FY10 necessitating the cost cutting measure of a one year delay on all increments, by passage of Resolution No. RS2009-803; and

WHEREAS, due to the economy, the Metropolitan Government also needs to implement cost saving measures for FY11; and

WHEREAS, it is recognized that employees of the Metropolitan Government have not experienced a pay plan increase since 2007: and

WHEREAS, in light of the necessity to implement cost saving measures but still address the financial needs of the employees of the Metropolitan Government, the Metropolitan Civil Service Commission has approved and recommended to the Director of Finance another one year delay on all increments, and replacing increments with a one time only two (2%) percent of salary lump sum payroll adjustment, capped at $2,000; and

WHEREAS, there is a recognized need to insure that all full time employees receive at least a Minimum hourly rate; and

WHEREAS, the Director of Finance has approved the recommendations of the Civil Service Commission and forwarded the same with a statement of full budgetary implications to the Mayor for his approval; and,

WHEREAS, the Mayor has approved the plan and recommends its adoption by the Metropolitan County Council.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The pay plan for employees of the Metropolitan Departments of Fire and Police, established by Resolution No. RS2005-873, and as subsequently amended, is hereby amended by delaying all current and future increment advances for a period of one year from the date of eligibility for the increment increases. The amended pay plan shall be as provided in Exhibit A and shall take effect on July 1, 2010. Exhibit A is incorporated into this Resolution as if fully set out herein.

Section 2: Effective July 1, 2011, the pay plan for employees of the Metropolitan Departments of Fire and Police, established by Resolution No. RS2005-873, and as subsequently amended, will reinstate increment advances as provided in Exhibit B. Exhibit B is incorporated into this Resolution as if fully set out herein.

Section 3: All full time employees of the Metropolitan Departments of Fire and Police, working a minimum of 32 hours per week, hired before January 1, 2010 and still employed by the Metropolitan Government on August 1, 2010, shall be paid two (2%) percent of their June 30, 2010 base salary as a lump sum payroll adjustment, capped at $2,000. The salary adjustment shall be paid by August 13, 2010 and will be subject to all applicable employment taxes and court ordered deductions.

Section 4: The amount of $10.77 per hour is established as the Minimum hourly rate for full time employees for the Metropolitan Government. The Civil Service Commission shall adopt rules and regulations to insure that no full time employee, compensated pursuant to this pay plan for employees of the Metropolitan Departments of Fire and Police, is paid a wage below this rate.

Section 5: This Resolution shall take effect on July 1, 2010, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
