ORDINANCE BL2017-1037

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main, a sanitary sewer manhole and easements and to accept new sanitary sewer main, sanitary manholes and easements for properties located at 903 and 905 Curdwood Boulevard, (MWS Project No. 16-SL-252 and Proposal No. 2017M-085ES-001).

WHEREAS, the abandonment of approximately 218 linear feet of existing eight inch sanitary sewer main, a sanitary sewer manhole and easements, and the acceptance of approximately 246 linear feet of new eight inch sanitary sewer main, two sanitary sewer manholes and any associated easements for properties located at 903 and 905 Curdwood Boulevard, are needed to construct project number 16-SL-252; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M 085ES-001 on October 27, 2017, for the abandonment and acceptance of said sanitary sewer mains, sanitary sewer manholes and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 218 linear feet of existing eight inch sanitary sewer main, a sanitary sewer manhole and easements, and to accept approximately 246 linear feet of new eight inch sanitary sewer main, two sanitary sewer manholes and any associated easements, for properties located at 903 and 905 Curdwood Boulevard, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
