ORDINANCE NO. BL2012-270

An ordinance approving the Metropolitan Government to accept an easement and eight hundred sixty-eight feet (868’) of an eight inch (8”) water main, two (2) fire hydrants and to also accept one thousand two hundred eighty four feet (1,284’) of an eight inch (8”) sewer main on property located at Duncanwood Drive (unnumbered) (Project No. 11-WL-0090 & 11-SL-0098) (Proposal No. 2012M-021ES-001 and 2012M-021ES-002).

WHEREAS, The acceptance of the water and sewer mains are needed to construct the Duncanwood Reserve Project, MWS numbers 11-SL-98 and 11WL-90 on properties located on Duncanwood Drive; and,

WHEREAS, The Metropolitan Planning Commission approved mandatory referral No. 2012M-021ES-001 on June 19, 2012 and No. 2012M-021ES-002 on August 24, 2012, for acceptance of said water and sewer mains and easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government is authorized to accept an easement, sewer mains, water mains, and fire hydrants on properties listed below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
