ORDINANCE NO. BL2012-223

An ordinance authorizing the acquisition and/or exchange of property for the purpose of acquiring land for recreational use by the Metropolitan Government as part of the Mill Creek Greenway (Proposal No. 2012M-021PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County ("Metro") is the owner of property known as Davidson County Tax Map 181-00-0 Parcel 022.00, also known as 6036 Culbertson Rd. and shown on Exhibit A; and

WHEREAS, Douglas and Jeanette Bendle own an approximately 7.19 acre vacant tract of land known as Davidson County Tax Map 173-00-0 Parcel 079.00, also known as 2191 Blake Dr. (and shown on Exhibit A) adjacent and adjoining to the Park property and where additional land is required and the opportunity exists to exchange land as compensation for the new property; and

WHEREAS, Douglas and Jeanette Bendle have offered the fee simple ownership of an approximately .39 acre portion of their property at 2191 Blake Dr. (as shown on Exhibit B) to the Metropolitan Government for use as park land; and

WHEREAS, Douglas and Jeanette Bendle would in exchange receive fee simple ownership of an approximately .39 acre portion of property from The Metropolitan Government of Nashville & Davidson County (as shown on Exhibit C); and

WHEREAS, it is in the public interest that land be acquired for use in the construction of the Mill Creek Greenway; and

WHEREAS, the Metropolitan Board of Parks & Recreation has approved both the acceptance of the .39 acre portion of 2191 Blake Dr. and disposal of the .39 acre portion of 6036 Culbertson Road property; and

WHEREAS, the Metropolitan Planning Commission approved this acquisition on June 14, 2012, Proposal No.2012M-021PR-001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Director of Public Property Administration is hereby authorized to exchange the herein described land for use by Metro Parks & Recreation, the same being for a public purpose and the public convenience requiring it.

Section 2. The property to be acquired is shown on Exhibit B, attached hereto and incorporated herein.

Section 3. All necessary and incidental costs of the herein authorized to be acquired shall be paid from funds authorized from the Capital Plan approved by Resolution RS2010-1363 for use in the Mill Creek Greenway.

Section 4. Any amendment to the described exchange of these properties, for these same purposes, may be authorized by resolution.

Section 5. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
