ORDINANCE NO. BL2010-646

An ordinance abandoning a 19.5 foot public utility easement, a 20 foot sanitary sewer easement, and a 4,491.74 total square foot public utility easement in connection to Project 10-AB-0001, 2312 Clifton Avenue, shown on Map 92-11, Parcel 386.00 and authorizing the execution of the documents to carry out said transaction (Proposal No. 2010M-015ES-001).

WHEREAS, a 19.5 foot public utility easement, a 20 foot sanitary sewer easement, and a 4,491.74 total square foot public utility easement, more particularly described in Project No. 10-AB-0001, 2312 Clifton Avenue, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2010M-015ES-001 on February 2, 2010 for abandonment of said easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the 19.5 foot public utility easement, the 20 foot sanitary sewer easement, and the 4,491.74 total square foot public utility easement that are of record by Ordinance Number 79-1252 for the 19.5 foot public utility easement, Instrument Number 20070125-0010374 for the 20 foot sanitary sewer easement and Instrument number 2000305-0026279 for the 4,491.74 total square foot public utility easement of the R.O.D.C., shown on Map 92-11, Parcel 386.00, 2312 Clifton Avenue as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonments authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
