ORDINANCE NO. BL2009-532

An Ordinance authorizing The Metropolitan Government of Nashville and Davidson County to accept donations of real property for use as part of the parks system (Proposal No. 2009M-014PR-001).

WHEREAS, Greenways for Nashville owns Parcel 94 on Tax Map 084-05 adjacent to Shelby Park; and,

WHEREAS, Greenways for Nashville desires to donate approximately 9.62 acres of land, which is Parcel 94 on Davidson County Tax Map 084-05, as further identified in Exhibit A, to the Metropolitan Government for the use and benefit of the Metropolitan Board of Parks and Recreation; and,

WHEREAS, Friends of Beaman owns Parcel 33.01 and a portion of Parcel 126 on Tax Map 38 adjacent to Beaman Park; and,

WHEREAS, Friends of Beaman desires to donate approximately 5.68 acres of land, which is Parcel 33.01 and a portion of Parcel 126 on Tax Map 38, as further identified in Exhibit B, to the Metropolitan Government for the use and benefit of the Metropolitan Board of Parks and Recreation; and,

WHEREAS the Board of Parks and Recreation recommends that the Metropolitan Government accept these properties.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Metropolitan Council hereby authorizes the acceptance of the donation of the subject property, as shown on Exhibits A and B, attached hereto and incorporated herein by reference.

Section 2. The Director of Public Property Administration, or his designee is hereby authorized to accept said property title, in the form of a warranty deed.

Section 3. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
