ORDINANCE NO. BL2009-530

An ordinance authorizing the Director of Public Property, or his designee, to accept and record easements in favor of the Metropolitan Government, for the use and benefit of the Greenway Commission, on certain parcels of property for use in the greenway system.

WHEREAS, the owners of the parcel of property shown on the documents attached as Collective Exhibit A to this ordinance agreed to donate an easement on his property to the Metropolitan Government, for the use and benefit of the Greenway Commission; and,

WHEREAS, the easement will be used to construct, operate and maintain portions of the greenway system; and

WHEREAS, the easement will be dedicated with a separate agreement substantially in the form of the document attached as Exhibit B to this ordinance; and

WHEREAS, the citizens of Nashville and Davidson County will benefit by accepting the donated easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of Public Property, or his designee, is authorized to accept and record easements from the owner of the parcel of property shown on Collective Exhibit A. The easements shall be dedicated with a separate agreement substantially in the form of Exhibit B.

Section 2. In the alternative, if negotiations relating to acceptance of an easement from the owner the parcel of property shown on Collective Exhibit A results in an agreement that is substantially different from the form attached hereto as Exhibit B, such revised agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2009-530 as follows:

1. By replacing the word “his” in the first recital following the caption with the word “their.”
2. By deleting Section 1 as drafted and replacing it with the following:
Section 1. The Director of Public Property Administration, or his designee, is authorized to accept and record an easement from the owners of the parcel of property shown on Collective Exhibit A. The easement shall be dedicated with a separate agreement substantially in the form of Exhibit B.
3. By substituting the attached for Collective Exhibit A thereto.
