ORDINANCE NO. BL2009-495

An ordinance abandoning a 20 foot public utility easement in connection with Project 08-SG-0103, 544 McMurray Drive, shown on Map 161-03, Parcel 160.00 and authorizing the execution of the documents to carry out said transaction (Proposal No. 2007M-061U-10).

WHEREAS, a 20 foot Public Utility Easement, more particularly described in Project No. 08-SG-0103, 544 McMurray Drive, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-231U-12 on December 11, 2008 for abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the Public Utility Easement, shown on Map 161-03, Parcel 160.00, Project No. 08-SG-0103 544 McMurray Drive as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
