ORDINANCE NO. BL2009-447

An ordinance authorizing the acquisition of property by negotiation or condemnation and acceptance for the purpose of acquiring easements for use in a public project described in the plans for 245, 247, 249, 251, and 253 Lovell Street.

WHEREAS, grants of certain easements have been executed by the respective property owners and offered to the Metropolitan Government of Nashville and Davidson County; and,

 WHEREAS, those easements are described in the plans for the Project on file with the Department of Water and Sewerage Services, and are located on the property described in Exhibit 1 hereto.

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-158G-4 on August 8, 2008 for acquisition and acceptance of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY. 

Section 1.         The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration is hereby authorized to accept from the respective property owner certain easements as described in the plans for this Project on file with the Department of Water and Sewerage Services, and located on the property described in Exhibit 1 hereto, which plans and exhibit are incorporated herein.

Section 2.         The easement shall be filed in the Office of the Register of Deeds to evidence their acceptance.

Section 3.         Amendments to this legislation shall be approved by resolution.

Section 4.         This ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
