ORDINANCE NO. BL2009-378
An ordinance authorizing the acceptance of certain easements for stormwater projects located at Tennyson Avenue, 2556 and 2560 Jordan Ridge Drive, 217 Donelson Pike, 1501 Corporate Place, 7661 Highway 70 South, 377 Athens Way, 744 East Argyle Avenue, 544 McMurray Drive, 110 One Mile Parkway, 2712 Shacklett Drive, 3544 Dickerson Pike, Tulip Grove Road, 7240 and 7254 Centennial Place, 2195 Nolensville Pike, East Campbell Road and 101 East Campbell Road, Briley Park Boulevard South and 3366 Briley Park Boulevard South, 1112 Brick Church Pike, 715 Massman Drive, 590 Cheron Road, 431 Old Hickory Boulevard, 105 Linda Court, 7100 Charlotte Pike, 4806 Trousdale Drive, and 104 Gupton Court.
WHEREAS, as shown in the documents collectively attached as Exhibit A to this ordinance, easements necessary for the Metropolitan Government to carry out various stormwater projects (the “Projects”) have been executed by the owners of the affected properties and offered to the Metropolitan Government of Nashville and Davidson County; and
WHEREAS, the easements are shown in Exhibit B hereto and further described in the Metropolitan Water and Sewerage Services Department’s plans on file for the Projects; and
WHEREAS, acceptance of the easements will benefit the citizens of Nashville and Davidson County.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept from the respective property owners the easements attached as Exhibit A.
Section 2. The easements shall be filed in the Office of the Register of Deeds after acceptance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
