ORDINANCE NO. BL2008-347

An ordinance authorizing the acceptance of certain easements for stormwater projects located at 1515 Lebanon, 820 Dominican Drive, Highway 70 South, 2406 Crestmoor Road, 3514 Pin Hook Road, 3334 Hamilton Church Road, 901 South 5th Street, 7201 Charlotte Pike, 726 Old Hickory Boulevard, 6509 Charlotte Pike, 8400 Highway 100, 1900 Belmont Boulevard, 2321 Crestmoor Road, 1608 County Hospital Road, 841 Briley Parkway, 6000 Highway 100, 3300 Elm Hill Pike, 5820 Nolensville Pike, 7100 Highway 70 South, 5621 Charlotte Pike, 310 Oceola Avenue, Hicks Road, 4540 Trousdale Drive, Dickerson Pike, and 2440 Music Valley Drive.

WHEREAS, as shown in the documents collectively attached as Exhibit A to this ordinance, easements necessary for the Metropolitan Government to carry out various stormwater projects (the “Projects”) have been executed by the owners of the affected properties and offered to the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, the easements are shown in Exhibit B hereto and further described in the Metropolitan Water and Sewerage Services Department’s plans on file for the Projects; and

WHEREAS, acceptance of the easements will benefit the citizens of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept from the respective property owners the easements attached as Exhibit A.
Section 2. The easements shall be filed in the Office of the Register of Deeds after acceptance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
