ORDINANCE NO. BL2008-289

An ordinance abandoning a 8" sanitary sewer line and easement and abandonment of a 1" water line and easement that will be replaced by a 8" sanitary sewer line and a 8" water line to be constructed in a dedicated right-of-way in connection Project 07-SL-0185/07-WL-0124, The Woods at Monticello Phase 1, shown on Map 071-01, Parcels 075, 076, 088, and 089, 437 Monticello Street, 2404 Monticello Street, and Monticello Street and authorizing the execution of the documents to carry out said transaction (Proposal No. 2008M-092U-3).

WHEREAS, an 8" existing sanitary sewer line and accompanying easement, and a 1" water line and easement more particularly described in Project No. 07-SL-0185/07-WL-0124, located at The Woods at Monticello Phase 1, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-092U-3 on May 23, 2008 for abandonment of said easement and sanitary sewer line and water line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the old 8" sanitary sewer line and easement and old 1" water line and easement and accepts a replacement 8" sanitary sewer line and easement and replacement water line shown on Map 071-01, Parcels 075, 076, 088, and 089, Project No. 07-SL-0185/07-WL-0124, The Woods at Monticello Phase 1, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 2. Further amendments to this Legislation may be approved by Resolution.

Section 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
