ORDINANCE NO. BL2008-265

An ordinance authorizing the acquisition and acceptance of certain easements described in the plans for 109 and 111 Dellway Drive, and 2700 A and 2703 Brunswick Drive Stormwater Project. No. 06-D-00904, Brunswick Drive, (Proposal No. 2007M-197U-5).

WHEREAS, grants of a certain easement have been executed by the respective property owners and offered to the Metropolitan Government of Nashville and Davidson County; and,

WHEREAS, those easements are described in the plans for Project No. 06-D-00904, on file with the Department of Water and Sewerage Services, and are located on the property described in Exhibit 1 hereto.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration is hereby authorized to accept from the respective property owners a certain easement as described in the plans for Project No. 06-D-00904, on file with the Department of Water and Sewerage Services, and located on the property described in Exhibit 1 hereto, which plans and exhibit are incorporated herein.

Section 2. The easement shall be filed in the Office of the Register of Deeds to evidence their acceptance.

Section 3. Further amendments to this legislation may be approved by Resolution.

Section 4. This ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
