ORDINANCE NO. BL2008-124
An ordinance abandoning the easement rights in a previous right-of-way that is shown on Map 105-06, Parcel 264.00, Project 07-SC-0210, former Trabue Street Abandonment, 700 Hamilton Avenue and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2007M-232U-11).
WHEREAS, an existing easement rights that were retained in a previous right-of-way, more particularly described in Project No. 07-SC-0210, Trabue Street Abandonment, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and
WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2007M-232U-11 on November 26, 2007 for abandonment of said easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Government hereby abandons the easement rights in a previous right-of-way that was retained shown on Map 105-06, Parcel 264.00, Project No. 07-SC-0210, Trabue Street Abandonment, as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
SECTION 2: Any further amendments to this Legislation may be processed by Resolution.
SECTION 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
