An ordinance authorizing the acceptance of certain easements for stormwater projects located at 4200 Hillsboro Pike, 2209 Buena Vista Pike, 554 Hickory Hills Boulevard, 5743 Temple Road, Highway 70 South, 2022 West End Avenue, 334 Woodycrest Avenue, 99 Lester Avenue, 3474 Dickerson Pike, 1507 8th Avenue North, 643 Myatt Drive, 266 Hermitage Avenue, 6201 Hickory Valley Road, 1224 Donelson Street, McCrory Lane, 2312 Clifton Avenue, 718 Murfreesboro Pike, 431 Old Hickory Boulevard, 300 5th Avenue South, 4320 Harding Pike, 1621 Heil Quaker Boulevard, 1409 Antioch Pike, 1624 Rebecca Street, 5520 Nolensville Pike, 1200 Broadway, 5410 Nolensville Pike and 3809 Bedford Avenue.

WHEREAS, it is in the public interest that easements be acquired to permit the construction of or other use for stormwater management (the “Project”) within the area designated for the construction of certain stormwater projects; and

WHEREAS, pursuant to the documents collectively attached as Exhibit 1, certain easements have been offered to the Metropolitan Government of Nashville and Davidson County for use in connection with the Project;

WHEREAS, the Metropolitan Planning Commission approved this acquisition on March 28, 2007; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metopolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration is hereby authorized to accept the easements shown in Exhibit 1 attached hereto and incorporated herein for use in connection with the Project.

Section 2. The easements shall be filed in the Office of the Register of Deeds.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
