An ordinance authorizing the acquisition of certain easements for stormwater projects located at 6016 and 6433 Nolensville Pike, 823 3rd Avenue North, 2900 and 1717 Lebanon Road, 2201 8th Avenue South, 1105 18th Avenue South, 4930 Linbar Drive, 1240 County Hospital Road, 510 Madison Street, 303 Oceola Avenue, 3410 Gallatin Pike, 613 26th Avenue North, 167 Lafayette Street, Fairfield Avenue, 7450 Old Hickory Boulevard, Cooper Lane and Polk Avenue.

WHEREAS, it is in the public interest that easements be acquired to permit the construction of or other use for stormwater management (the “Project”) within the area designated for the construction of certain stormwater projects; and

WHEREAS, pursuant to the documents collectively attached as Exhibit 1, certain easements have been offered to the Metropolitan Government of Nashville and Davidson County for use in connection with the Project;

WHEREAS, the Metropolitan Planning Commission approved this acquisition on February 8, 2007; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept the easements shown in Exhibit 1, attached hereto and incorporated herein, for use in connection with the Project.

Section 2. The easements shall be filed in the Office of the Register of Deeds.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
