An ordinance authorizing the acquisition of certain easements for stormwater projects of the Metropolitan Government located at 3831 and 3837 Hutson Avenue, and 3812 and 3822 Edwards Avenue (Proposal No. 2006M-174U-05).

WHEREAS, it is in the public interest that easements be acquired to permit the construction of or other use for stormwater management (the “Project”) within the area designated for the construction of certain stormwater projects; and

WHEREAS, pursuant to the documents collectively attached as Exhibit 1, certain easements have been offered to the Metropolitan Government of Nashville and Davidson County for use in connection with the Project;

WHEREAS, the Metropolitan Planning Commission approved this acquisition on October 10, 2006.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept the easements shown in Exhibit 1, attached hereto and incorporated herein, for use in connection with the Project.

Section 2. The easements shall be filed in the Office of the Register of Deeds.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
