ORDINANCE NO. BL2006-947
An ordinance abandoning an 8" sanitary sewer line and easement that will be replaced by an 8" sanitary sewer line and easement by plat, that is shown on Map 104-09, Parcel 166.00, Project 05-SL-0120, Nelley Residence Sewer, and authorizing the execution of the documents to carry out the abandonment. (Proposal No. 2005M-210U-10).
WHEREAS, an 8" existing sanitary sewer line and accompanying easement, more particularly described in Project No. 05-SL-0120, Nelly Residence, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and
WHEREAS, a 8" sanitary sewer line and easement of equal size will be replacing the existing 8" sanitary sewer line and easement by plat; and
WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2005M-210U-10 on November 15, 2005 for abandonment of said easement and sanitary sewer line.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Government hereby abandons the 8" sanitary sewer line and the easement shown on Map 104-09, Parcel 166.00, Project No. 05-SL-0120, Nelley Residence as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
