ORDINANCE NO. BL2005-870

An ordinance authorizing the acquisition of easements by negotiation or condemnation for use in Public Works Project Number 05-R-05, Smith Springs Parkway Extension from Paddington Way to Arvington Way, a public project of the Metropolitan Government (Proposal No. 2005M-222U-13).

WHEREAS, it is in the public interest that easements be acquired to permit the extension of Smith Springs Parkway from Paddington Way to Arvington Way, pursuant to Public Works Project Number 05-R-05; and,

WHEREAS, Project No. 05-R-05, Smith Springs Parkway Extension, has been authorized under Capital Improvements Budget No. 02PW020, Roadway Improvements-GSD.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Director of Public Property Administration is hereby authorized to acquire by negotiation or condemnation the following described interests in real property for use in Public Works Project Number 05-R-05, Smith Springs Parkway Extension from Paddington Way to Arvington Way, a public project of the Metropolitan Government, the same being for a public purpose and the public convenience requiring it.

Section 2. The easements to be acquired are on property located at Map 151 Parcel 18, as further described in the Exhibits attached hereto and incorporated herein.

Section 3. The Director of Public Property Administration is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the interests in real property described herein in the name of The Metropolitan Government of Nashville and Davidson County for use in Public Works Project Number 05-R-05, Smith Springs Parkway Extension from Paddington Way to Arvington Way.

Section 4. All necessary and incidental costs of the easements herein authorized to be acquired shall be paid from funds authorized from Fund No. 40190 BU42411190.

Section 5. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
