ORDINANCE NO. BL2005-623
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development District located at Charlotte Pike (unnumbered), 6806 Charlotte Pike, Annex Avenue (unnumbered) abutting the north margin of Charlotte Pike and the south margin of I-40, to permit the development of 474,484 square feet of retail, restaurant and office use and 24 residential units (53.10 acres), all of which is described here in (Proposal No. 2004P-036U-07).
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:
By making applicable the provision of a Planned Unit Development Distict to property located at Charlotte Pike (unnumbered), 6806 Charlotte Pike, Annex Avenue unnumbered abutting the north margin of Charlotte Pike and the south margin of I-40 to permit the development of 474,484 square feet of retail, restaurant and office use and 24 residential units, as being Property Parcel No. 22, 23, Part of 24 and 26 as designated on Map 102 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.
Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 102 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.
Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:
I move to amend Ordinance No. BL2005-623 as follows:
1. By renumbering Section 2 as Section 3.
2. By renumbering Section 3 as Section 4.
3. By adding the following new Section 2.:
Section 2. Be it
further enacted, that the developer shall meet the following conditions:
1. Any and all trucks used during the construction phases of the development
shall not use the local interior streets of the Hillwood neighborhood, but shall
use arterial and collector streets including Davidson Road, White Bridge Road,
and Charlotte Pike.
2. The developer shall deposit the sum of fifty thousand dollars ($50,000) in
escrow to be used for traffic calming and beautification for traffic reasons
on and affecting Annex Avenue.
3. The developer shall deposit the sum of one hundred fifty thousand dollars
($150,000) in escrow to be used for traffic calming and beautification within
the affected areas of the Hillwood neighborhood and surrounding areas.
