ORDINANCE NO. BL2004-370

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for the Metropolitan Government of Nashville and Davidson County, specifically with relation to the construction of a new Head Start Center in the Nolensville Road area for the use and benefit of the Metropolitan Action Commission (Proposal No. 2004M-090U-12).

WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to “…purchase…or otherwise acquire …property… for any public purpose”; and

WHEREAS, it is in the public interest that certain property, 5.46 acres more or less, identified as Parcel 042 on Tax Map 147-11 and as described on Exhibit A hereto (the “Property”), be acquired through negotiation or condemnation for the construction of a new Head Start Center in the Nolensville Road area, for the use and benefit of the Metropolitan Action Commission; and

WHEREAS, the funds to defray the cost of this public project are available from Fund Number 40170, Business Unit Number 75404100.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire the Property by negotiation or condemnation.

Section 2. The Director of Public Property Administration, or his designee, is hereby authorized to accept title to the Property, in the form of a warranty deed.

Section 3. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson requiring it.
