An ordinance authorizing the Metropolitan Government to participate with JCH Development Co., LLC, for the construction of Project No. 02-SL-22, Long Hunter Chase, Phase 3, Section 2, and execute the necessary documents.

WHEREAS, JCH Development Co., LLC, has expressed a desire to provide public sewer service to the Hobson Pike/Mt. View Road area, known as Long Hunter Chase, Phase 3, Section 2; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, will need to upgrade the Towne Village Pumping Station as a result of this project and others (Project No. 95-SG-114); and

WHEREAS, it is deemed in the best interest of the public to construct said improvements, and JCH Development Co., LLC, has agreed to pay a proportionate share of the cost of the upgrades in the amount of $30,000.00; and

WHEREAS, this work is identified in Metro’s Capital Improvement Budget as CIB No. 96SG0003; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. That the Metropolitan Director of the Department of Water and Sewerage Services, acting for the Metropolitan Government is hereby authorized to execute a participation agreement, Exhibit 1, with JCH Development Co., LLC, to provide public sewer services in the Hobson Pike/Mt. View Road area, known as Long Hunter Chase, Phase 3, Section 2, Project No. 02-SL-22.

SECTION 2. That the $30,000.00 received as a contribution-in-aid of construction will be deposited in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
