The Metropolitan Council met in special session on this date at 4:15 p.m. in the Metropolitan Courthouse.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Garrett, Barry, Maynard, Harrison, Hunt, Craddock, Hollin, Jameson, Cole, Bennett, Forkum, Ryman, Jernigan, Gotto, Burch, Stanley, Claiborne, Page, Moore, LaLonde, Gilmore, Baker, Langster, Crafton, Holleman, McGuire, Adkins, Foster, Dominy, Wilhoite, Hodge, Toler, Todd, Mitchell and President Neighbors (35); Absent: Tygard, Steine, Matthews, Evans, Coleman, Duvall (6).

Ladies and Gentlemen:

I am calling a Special Meeting of the Council pursuant to Section 3.04 of the Charter of the Metropolitan Government of Nashville and Davidson County to be held on Tuesday, September 7, at 4:15 p.m., prior to our regular 6:00 Zoning Public Hearing meeting, for the purpose of considering amendments to the Metropolitan Charter proposed by various Members of Council, as well as two bond resolutions submitted by the Administration. A list of the specific items to be considered is as follows:

A resolution authorizing a loan under a loan agreement between the Metropolitan Government and the Tennessee State School Bond Authority in an aggregate principal amount not to exceed $40,000,000; and providing for the application of the loan proceeds and the payment of the Metropolitan Government’s obligations under the loan agreement.

A resolution authorizing the execution, terms, issuance, sale and payment of general obligation refunding bonds in one or more series in the aggregate principal amount of not to exceed $350,000,000.

No other matters shall be considered at this meeting, and I encourage your attendance.

RESOLUTION NO. RS2008-431

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The resolution was disapproved by the Charter Revision Commission; the Charter Revision Committee made no recommendation. Mr. Gotto offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Gotto moved to adopt the proposed Charter amendment, as amended, which motion was seconded and failed by the following vote: “Ayes” Harrison, Hunt, Craddock, Hollin, Bennett, Gotto, Stanley, Claiborne, Crafton, Foster, Dominy, Wilhoite (12); “Noes” Garrett, Barry, Maynard, Jameson, Cole, Forkum, Ryman, Jernigan, Page, Moore, LaLonde, Gilmore, Baker, Langster, Holleman, McGuire, Adkins, Hodge, Toler, Todd, Mitchell (21).

RESOLUTION NO. RS2009-989

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The resolution was disapproved by the Charter Revision Commission and the Charter Revision Committee. Mr. Crafton moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2009-1020

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The resolution was disapproved by the Charter Revision Commission and the Charter Revision Committee. Ms. Wilhoite moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2010-1118

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The resolution was approved by the Charter Revision Commission; the Charter Revision Committee recommended indefinite deferment. Mr. Foster moved to defer the resolution indefinitely, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2010-1119

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The resolution was approved by the Charter Revision Commission and Charter Revision Committee. Mr. Forkum offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Crafton offered Amendment No. 2 and moved for its adoption, which motion was seconded. After further discussion, Mr. Crafton moved to withdraw his amendment, which motion was seconded and adopted by a voice vote of the Council.

Mr. Forkum moved to adopt the proposed Charter amendment, as amended, which motion was seconded and adopted by the following vote: “Ayes” Garrett, Barry, Maynard, Harrison, Hunt, Craddock, Hollin, Jameson, Cole, Bennett, Forkum, Ryman, Jernigan, Gotto, Burch, Stanley, Claiborne, Page, Moore, LaLonde, Gilmore, Baker, Langster, Crafton, Holleman, McGuire, Adkins, Dominy, Wilhoite, Hodge, Toler, Coleman, Todd, Mitchell (34); “Noes” Foster (1).

RESOLUTION NO. RS2010-1270

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The resolution was disapproved by the Charter Revision Commission and the Charter Revision Committee. Mr. Foster moved to adopt the proposed Charter amendment, which motion was seconded and failed by the following vote: “Ayes” Harrison, Hunt, Craddock Bennett, Gotto, Stanley, Dominy, Wilhoite, Toler (9); “Noes” Garrett, Barry, Maynard, Hollin, Jameson, Cole, Forkum, Ryman, Jernigan, Burch, Claiborne, Page, Moore, LaLonde, Gilmore, Baker, Langster, Crafton, Holleman, McGuire, Adkins, Foster, Hodge, Coleman, Todd, Mitchell (26).

RESOLUTION NO. RS2010-1318

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The resolution was disapproved by the Charter Revision Commission. The Charter Revision Committee recommended withdrawal. Mr. Ryman moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.

Resolution Nos. RS2008-431 and RS2010-1270 were withdrawn without objection at this time. A final vote on Resolution No. RS2010-1119 with one proposed Charter amendment was then taken.

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. Mr. Forkum moved to adopt the resolution with the one approved Charter amendment, , which motion was seconded and adopted by the following vote: “Ayes” Garrett, Barry, Maynard, Harrison, Hunt, Craddock, Hollin, Jameson, Cole, Bennett, Forkum, Ryman, Jernigan, Gotto, Burch, Stanley, Claiborne, Page, Moore, LaLonde, Gilmore, Baker, Langster, Crafton, Holleman, McGuire, Adkins, Dominy, Wilhoite, Hodge, Toler, Coleman, Todd, Mitchell (34); “Noes” Foster (1).

RESOLUTION NO. RS2010-1361

A resolution authorizing a loan under a loan agreement between the Metropolitan Government of Nashville and Davidson County, Tennessee, and the Tennessee State School Bond Authority in an aggregate principal amount of not to exceed forty million dollars ($40,000,000) and the execution and delivery of the loan agreement and other documents relating to said borrowing; and providing for the application of the proceeds of said borrowing and the payment of the metropolitan government’s obligations under the loan agreement. The resolution was approved by the Budget and Finance Committee. Ms. Barry moved to adopt the resolution, which motion was seconded and adopted by the following vote: “Ayes” Garrett, Barry, Maynard, Harrison, Hunt, Craddock, Hollin, Jameson, Cole, Bennett, Forkum, Ryman, Jernigan, Gotto, Burch, Stanley, Claiborne, Page, Moore, LaLonde, Gilmore, Baker, Langster, Crafton, Holleman, McGuire, Adkins, Foster, Dominy, Wilhoite, Hodge, Toler, Todd, Mitchell (34); “Noes” (0).

Upon motion duly seconded, the meeting was adjourned.
