RESOLUTION NO. RS2010-1119

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot.

WHEREAS, Article 19.01 of the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, provides that the Metropolitan Government shall not adopt a resolution proposing amendments to the Charter more often than twice during the term of office of members of the Metropolitan Council; and

WHEREAS, Article 19, Section 19.01, also requires to be set forth in the adoption resolution a brief description of each amendment so worded so as to convey the meaning of said amendment; and

WHEREAS, it is the desire of the Metropolitan Council by adopting this resolution to fulfill these two Charter requirements.

NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Pursuant to the provisions of Section 19.01 of the Charter of The Metropolitan Government of Nashville and Davidson County, the proposed amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, attached hereto, are submitted to the people for approval in the manner provided by Section 19.01 of the Charter.

Section 2. The date prescribed for holding of the referendum election at which the electorate of the Metropolitan Government will vote to ratify or reject the amendments proposed in Section 1 of this Resolution shall be August 5, 2010.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Resolution No. RS2010-1119

Madam President:

I move to amend RS2010-1119 as follows:

1.  By substituting the proposed amendment to Article 12 of the Charter referenced in Section 1 with the attached new amendment.

2.  By amending Section 2 by deleting the date "August 5, 2010" and substituting with the date "November 2, 2010".

Section 12.05 of Article 12 of the Charter of The Metropolitan Government of Nashville and Davidson County shall be amended by deleting the provision of paragraph three and substituting with the following new provisions:
“No employee in the metropolitan service may hold more than one position
or employment in the metropolitan service except as follows:
(a) School personnel between school years may be employed to work in other departments;
(b) Certificated school personnel may be employed on a part-time basis to teach community education classes; and
(c) Non-elected employees in the metropolitan service may be employed by the metropolitan board of public education on a part-time basis to lead, teach, or coach students in extra-curricular activities and/or to serve as substitute teachers.
The civil service commission shall adopt and promulgate rules and regulations necessary for the implementation of this section.”

This amendment would allow employees of the Metropolitan Government to also serve as part-time employees of the Metropolitan Board of Public Education to lead, teach, or coach students in extra-curricular activities and/or to serve as substitute teachers, and would allow certificated employees of the Metropolitan Board of Public Education to teach community education classes on a part-time basis. The Civil Service Commission would have the responsibility for adopting and promulgating rules and regulations necessary for the implementation of this amendment.
