Metropolitan Council Meeting
Tuesday, December 17, 2002


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Sherman R. Tribble of New Visions Baptist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Action Commission
Appointment of Mr. Tahir A. Hussain to the Metropolitan Action Commission for a term expiring February 2, 2005. The Rules-Confirmations-Public Elections Committee recommended deferment. Without objection, the confirmation was deferred to the second meeting in January.

Auditorium Commission
Appointment of Mr. Randy Pomeroy to the Auditorium Commission for a term expiring June 30, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Fair Commissioners
Appointment of Ms. Katy Varney to the Board of Fair Commissioners for a term expiring April 6, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Wastewater Hearing Authority
Reappointment of Ms. Ruthie Brown Cherry for a term expiring October 1, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Larry Monroe for a term expiring October 1, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Greer moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2002-1230

A resolution approving the property at 10 Culvert Street to be used for a waste transfer station. The resolution was approved by the Planning, Zoning and Historical Committee. RESOLUTION NO. RS2002-1234

A resolution requesting the State of Tennessee to prohibit the issuance of Alcoholic Beverage licenses within the area of the Metropolitan Government at any location that does not meet the requirements for the sale of beer. The resolution was approved by the Public Safety-Beer, Wine and Whiskey Committee. RESOLUTION NO. RS2002-1281

A resolution proclaiming December 21, 2002 as “Homeless Memorial Day” in Nashville, Tennessee. The resolution was approved by the Personnel-Public Information-Human Relations-Housing Committee. RESOLUTION NO. RS2002-1282

A resolution requesting the Mayor and the Nashville Sports Authority to consider the feasibility of constructing a retracting roof or other means to enclose the Nashville Coliseum and to add additional seating. The Parks, Library, Recreation and Auditorium Committee recommended deferment. Mr. Wallace moved to defer the resolution, upon the committee recommendation, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2002-1283

A resolution requesting the Central Business Improvement District, the Downtown Partnership, The District, the Mayor’s Office, the Department of Public Works, and the Mayor’s Office of Economic Development to establish a program to provide for the display of appropriate holiday decorations and banners during the holiday season of the year 2002 and in the future. RESOLUTION NO. RS2002-1286

A resolution authorizing the Metropolitan Mayor to enter into Sewer Line Agreement No. 500,443 and 500,444 with Nashville and Eastern Railroad Corporation, allowing the Department of Water and Sewerage Services to construct and maintain sewer lines in the railroad right-of-way from Elm Hill Pike to Windemere Drive for the Briley Parkway widening project, Project No. 01-SG-92. The resolution was approved by the Budget and Finance and Public Works Committees with an amendment. RESOLUTION NO. RS2002-1293

A resolution authorizing and directing the Director of Public Property to exercise an option to purchase property (Tax Map 93-02, Parcel 24 – 432 Third Avenue North) for The Metropolitan Government of Nashville and Davidson County. RESOLUTION NO. RS2002-1297

A resolution authorizing Historic Hotels of Nashville, LLC to install, construct and maintain a granite inlay into the public sidewalk for the 'Hermitage Hotel', located at 231 6th Avenue North (Proposal No. 2002M-129U-09). Mr. Wallace moved to withdraw the resolution, as this type of proposal must be approved by ordinance, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County by closing an unnamed street, approximately 155 feet in length, extending north from Warfield Drive to its terminus, as requested by Kurt Denny, for Kurt Denny and the Royal Arms Apartments, abutting property owners (Proposal No. 2002M-121U-10). The bill was approved by the Planning Commission. An ordinance amending Section 12.40.040 of the Metropolitan Code by permitting parking within the Central Business Improvement District during certain evenings in some spaces where parking is now prohibited. The bill was disapproved by the Traffic and Parking Commission; the Traffic and Parking Committee recommended deferment. Mr. Brown moved to defer the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2001-822

An ordinance amending Section 12.08.150 of the Metropolitan Code by reducing the authority to tow vehicles illegally parked within the area of the Metropolitan Government. The Public Safety-Beer, Wine and Whiskey Committee recommended deferment. Mr. Wallace moved to defer the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2002-1246

An ordinance amending the Metropolitan Code of Laws to prohibit the enforcement of parking meters on Saturdays. The bill was approved by the Budget and Finance and Traffic and Parking Committees with an amendment. Mr. Wallace offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted without objection. Mr. Wallace moved to pass the bill on second reading as amended and to re-refer the bill to the Traffic and Parking Commission and Traffic and Parking Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2002-1274

An ordinance amending Title 11, Chapter 11.20 of the Metropolitan Code, Fair Employment and Housing Practices. The bill was approved by the Personnel-Public Information-Human Relations-Housing Committee. Ms. Beehan moved to pass the bill on second reading, refer to the Metropolitan Human Relations Commission, and re-refer to the Personnel-Public Information-Human Relations-Housing Committee, which motion was seconded and adopted by a roll call vote of the Council.

BILL NO. BL2002-1275

An ordinance authorizing the Mayor’s Office of Neighborhoods to accept cash donations and to appropriate sponsorship money that has been received into the general fund for the purpose of underwriting the cost of the 2002 “National Night Out Against Crime” conference and “Celebrating Neighborhoods” conference. The bill was approved by the Budget and Finance Committee. Mr. Jenkins moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2002-1276

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County by renaming the portion of 21st Avenue North between Clifton Avenue and Charlotte Avenue to “Shortview Avenue” (Proposal No. 2002M-105U-10), all of which is more particularly described herein. The bill was approved by the Planning Commission, ECD Board, Public Works, Traffic and Parking, and Planning, Zoning and Historical Committees. Mr. Whitmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
